RESPONSE OF THE ORDER ( TOWN OF AMESBURY, MASSACHUSETTS )

0F THE ATOMIC SAFETY AND LICENSING BOARD (2-28-86).

The Town of Amesbury, Massachusetts, having been admitted under the provisions of 10 CFR } 2.715(c) as ar, interested municipality, wishes to advise the Board of the subject matters on which the Town seeks to participate.

The Town of Amesbury has two chief concerns for participation in the above docketed proceedings. First, the Town wishes to participate in all litigation of contentions subject to NUREG-0654, FEMA-REP-1, Rev.1, I-E, Example No. 2, " Local Government Within the Plume Exposure Pathway (10-mile) Emergency Planning Zone Whose Boundaries Are Also a State Boundary." The two principH contentions before the Board on this matter appear to be SAPL CONTENTION #2 and NECNP #RERP 4(b). Seccndly, the Town of Amesbury wishes to participate in all contentions dealing with NHRERP Vol. 6 (also designated as local plans appendix E), currently refered to Costello, Lomasngy &

diNapoli ETS. Should the State of New Hampshire, FEMA, the NRC, or the Applicant choose to substitute any or all parts of the study being conducted by KLD Associates for either NHRERP Vol. 6 or for Appendix E of the local plans, the Town of Amesbury wishes to participate in litigation of all pertinent contentions.

It should be clear to all parties as per the discussion offered by the Town of Amesbury during the ASLB pre-hearing conference on March 26,1986, that both aforementioned studies contain considerably more data than simply time estimates. The occasional generic use of terms "ETE", "ETS", or " Time Study" should n6t preclude intervenors or interested parties, as admitted under provisions of 10 CFR g 2.714 and 2.715, the opportunity to question, witness, and cross-examine on all applicable contentions.
