1 All remediation work and final surveys have been completed per i the Cintichem Decommissioning Plan. We are currently preparing the l last sections of the Final Survey Report for the project and it l should be submitted for review and approval in May.

At this stage of the project we are anticipating the restoration of the site for future unrestricted use. One aspect of this restoration pertains to the surface water drainage system ,

which has been altered to accommodate the decommissioning worn that had to be done in certain areas on site. Containment of the i retention pond water, removal of buried tanks and piping and other I water management conditions that were encountered during the j decommissioning project required interruption or diversion of the tributaries to the retention pond (S-3,S-5&S-7) and ultimately to j outfall 002. S-3 and S-5 were temporarily-diverted to remediate surface soils in those general areas. S-7 was diverted permanently about two years ago to reduce the total flow to the retention pond to alleviate the problems and the risks associated with pumping retention pond water to the 001 outfall. This was particularly important to be able to do during periods of heavy rainfall.

Anticipating the restoration of these drainage pathways to the g original configuration, we are proposing to restore the flow of S-7 to the retention pond. We believe that this will not require a , ,I-modification to the order. Subparagraph V. (B) which permits the diversion would stay in the order but it would only become operative if we had to divert S-7 temporarily due to heavy rainf all. All other provisions of the Order would remain unchanged.

The retention pond water would still be retained and analyzed prior to discharge to the 001 outfall.

Ultimately, when confirmation surveys will have been completed by the NRC and af ter the NRC licenses and the DEC Consent Order are terminated, the restoration of the surf ace water drainage system will be completed by opening the retention pond outlet to 9705120314 970424 PDR ADOCK 05000054 lllfffllllllllllllllllll llll lllllll w PDR - = .

I the original 002 outfall at the reservoir. We believe that it is '

preferable to reestablish S-7 flow to the retention pond at this

time in order to develop a body of monitoring data of the retention

~ pond water with all of the S-12 tributaries restored to the original flow pattern in the drainage system before the licenses and other site restrictions are terminated.

We request your concurrence with this S-7 restoration at your earliest convenience. If we can stay on the current schedule we may have NRC confirmation surveys starting in early summer and license termination within a couple of months thereafter. We would like to have a few months of data from the retention pond under this final j configuration of the surface water drainage by then.
