Dear Mr. O'Hanlon:

Thank you for your response of May 23, 1997, to our Notice of Violation,
1
issued on May 5, 1997, concerning activities conducted at your North Anna
i
facility. We have evaluated your response and found that it meets the
requirements of 10 CFR 2.201.
!
Your response states, "Each chart recorder in question has an indicator and/or
l
redundant instruments that provide parameter indicatior, for operational
control. The charts are used for historical record and furthermmore, are not
i
required by Technical Specifications.
Based on the limited regulatory and
,
safety significance of the issue, it is requested that the Notice of Violation
i
be reconsidered for categorization as a Non Cited Violation. We believe that
!
this issue meets the requirements in the NRC Enforcement Manual for
categorization as a Non Cited Violation."

We have carefully considered the basis for your request to change the
!
categorization of the violation from Severity ievel IV violation to a Non-
Cited violation. The reasons that the issue was categorized as Severity Level
IV violation included: over a period of several days, shift crew members
initialed, dated and verified on multiple occasions that the recorders were
functioning properly, when they were not; supervisory control room )ersonnel
{
failed to note the discrepancies; and the issue was not identified ay your
!
personnel. The failure of control room personnel to correctly verify that
!
control room chart recorders were functional is more than a minor regulatory
l
concern, and therefore the criteria for a Non Cited violation as stated in
'
NUREG 1600, " General Statement of Policy and Procedures for NRC Enforcement
i
Actions" was not met.

Based on this review, we will examine the implementation of your corrective
actions)duringfutureinspections.
