Dear Mr. Nantz:

This is in response to_your letter to me dated June 22, 1984, in which you requested the authority and rationale for 2

closing the ACRS'research program and budget meetings of June 14 and 15, 1984.

The basis for my authority to make the decision whether to close any ACRS meeting is found in the Federal Advisory Committee Act (FACA), 5 U.S.C. App.

I, and.the NRC's implementation of FACA set forth in 10 C.F.R. Part 7.

Particularly note that in 10 C.F.R. 7. 9 (c), the determination to close an ACRS meeting will be made by the Commission, or pursuant to Section 7.9 (d), by the Commission's delegate.

As the Commission's designated Advisory Committee Management-officer (see 5 U.S.C. App. I, Sec. 8 and 10 C.F.R. 7.5), I have been i

Discretionary review by the Commission would depend on the legal and i

factual considerations inv'olved.

The ACRS research program and budget meetings were closed l

pursuant to the rationale of 10 C.F.R. 9.104 (a) (9)--the j

meeting may disclose information the premature disclosure of which would be likely to significantly frustrate bnplementation of a proposed ' Commission action.

The Office of Research indicated that if specific details of future research budgets (i.e.., who gets what money) are made public, it may frustrate 4

the effective continuation of present research contracts.

-people working under that contract would tend to seek work elsewhere or reduce their professional efforts under the

These activities would detract from or

. frustrate the expected results of the NRC contract.

Therefore, in order to allow the ACRS to obtain this information, which it needed to fulfill its statutory obligation to report to the Commission, the meeting was held in closed session.

With respect to your additional question regarding the expectation that some portions of the budget discussions would be open, I would comment that the May 21, 1984 notice

( 4 9 Fed. Reg. 21445-46) contained an advance notification of the June meeting agenda issued before the detailed nature of the discussions was established.

When the details of that proposed discussion became known as described above, I determined that those. portions of the meeting agenda should be entirely closed (49 Fed. Reg. 22728, May 31, 1984).

With respect to closure of the subcommittee meeting held on June 13, 1984, the advanced notification of May 21 was based on preliminary informstion.

As the detailed nature of the discussion was established (see June 1, 1984 Memorandum to File attached), that session was fully closed.

A specific notice was not considered necessary "in view of 41 CFR, i

Part 101-6 and lack of public inquiry regarding detailed arrangements for the meeting in response to the May 21, 1984 notification.

The ACRS Subcommittee on the Safety Research Program will hold a meeting on 13,1984, at 1717 H Street, N.W., Washington, D.C.

The Wednesday, June Subcommittee will discuss the continuing and proposed research programs that will have to be deferred or eliminated if the proposed RES budget for FY 1986 and 1987 has to' be reduced by 10-20 percent; it wil.1 also discuss a preliminary ACRS report to the Commission on the NRC Safety Research Program and Budget for FY 1986 and 1987, which would also involve a discussion of the research programs that will be affected if the proposed research budget has to be reduced significantly.

Further, the Subcommittee will discuss the impact of the 530 million reduction proposed by the House Appropriations Committee (for the NRC Safety Researen Program for FY 1985) on the continuing research and also on the proposed research for FY 1986 and 1987.

Such discussions, if held in public session, might result in the premature disclosure of infonna-tion which would in turn frustrate the Commission's ability to implement the affected programs effectively. Therefore, the entire meeting should be closed ( Analogous to Sunshine Act Exemption (9)b.).
