' On March 19,1997, the NRC completed an inspection at your Fermi 2 reactor facility.

!

'

The enclosed report presents the results of that inspection.

!

During this.6-week inspection period, engineering continued to identify design problems.

l

j

This continued a trend of broad, detailed investigations by engineering. In contrast,

{

inspectors continued to identify deficiencies in the performance of maintenance activities.

i

Also, the inspector identified several security issues involving lack of attention to detail.

i

!

Based on the results of this' inspection, the NRC has determined that one violation of NRC

l

,

requirements occurred. - The violation is cited in the enclosed Notice of Violation (Notice)

I

i

and the circumstances surrounding it are described in detail in the subject inspection

l

report. The violation is of concern because you did not have procedures to operate

)

equipment used to supply offsite power to the plant. This fact was identified as a

contributing factor in the motorizing of your main unit generator in January 1996, but your '

j

corrective actions did not include prompt action to mitigate that deficiency.

' Also in this report are the Notices of Violation for inspection findings reported in inspection

.j

!

Report No. 50-341/96201, conducted in August and September,1996. The violations

proposed by NRC Special Inspections Branch have been reviewed by Region Ill. Based on

the results of that inspection, the NRC has determined that two violations of NRC

requirements occurred. These violations are cited in the enclosed Notice of Violation

i

-(Notice) and the circumstances surrounding them are described in detail in Inspection

'

Report No. 50-341/96201. The first violation is of concern because instructions contained

incorrect acceptance criteria for determining operability of safety systems. The second

violation is of_ concern because your staff was not raising issues to managements'

i

attention as directed in your procedures.

You are required to respond to this letter and should follow the instructions specified in the

!

enclosed Notice when preparing your response. The NRC will use your response, in part,

to determine whether further enforcement action is necessary to ensure compliance with

In addition, two apparent violations were identified and ere being considered for escalated

enforcement action in accordance with the " General Statement of Policy and Procedure for

NRC Enforcement Actions" (Enforcement Policy), NUREG-1600. The two apparent

violations are of concern because your staff did not recognize the significance of a non-

i

conservative error introduced by your calibration practices of primary containment accident

i

monitoring instruments. In addition, your staff failed to take timely and appropriate

corrective actions. As a result, you exceeded technical specifications requirements on

i

several occasions and you could have potentially been outside the design basis for primary

containment during a design basis accident. Please be advised that the number and

characterization of apparent violations described in the enclosed inspection report may

l

change as a result of further NRC review.

You will be advised by separate correspondence of the results of our deliberations on the

apparent violations. No response regarding these apparent violations is required at this

time.
