Dear Licensing Board Members:
In accordance with the proposed schedule in " Motion To Esta-l blish Schedule For Hearings" (October 15, 1985), which was supported 3
by all parties, Florida Power & Light Company (Licensee) hereby submits " Licensee's Motion For Summary Disposition Of Intervenors' l
Contentions" (January 23, 1986).
In support of this Motion, Licensee is also submitting " Licensee's Statement Of Material Facts As To Which There Is No Genuine Issue To Be Heard With Respect To Intervenors' Contentions" (January 23, 1986) and eleven affidavits.
As is demonstrated in the Motion, there is no genuine issue of material fact regarding the Intervenors' contentions, I
and the Licensee is entitled to a decision as a matter of law.
l Accordingly, Licensee requests that the Licensing Board grant Licensee's Motion and dismiss this proceeding.
