4 A RESOLUTION REQUESTING THE NUCLEAR REGULATORY COMMISSION TO RESCIND APPROVAL FOR THE DISPOSAL OF RADIOACTIVE WASTE AT THE DAVIS-BESSE PLANT SITE WHEREAS, the Nuclear Regulatory Conunission has approved the request of Toledo Edison Company and the Cleveland Electric Illuminating Company to dispose of low-level radioactive wastes on the Davis-Besse Plant Sites and WHEREAS, the Mayor and Council deem that the action of 4

the Nuclear Regulatory Commission establishes a precedent for storage of nuclear wastes at other nuclear facility sites and WHEREAS, radioactive waste is toxic and harmful to humans

,and the environment, causes cancer, birth defects, genetic damage and irreversible harm to the biosphere.  !

NOW THEREFORE, BE IT RESOLVED by the Council of the City ,

of Mayfield Heights, State of Ohio Section la The the Mayor and Council of the City of Mayfield Heights hereby requests the Nuclear Regulatory Conrnission on ltorescinditsapprovalforthedisposalofradioactivewastes the site of the Davis-Besse Plant.

Authorized and directed to forward a copy of this Resolution to

the Nuclear Regulatory Conunission, Senators John Glenn, Howard Metzenbaum, U.S. Representatives, Edward F. Feighan, Dennis E.

Eckart, Ohio Governor Richard F. Celeste, Ohio Sentator, Lee I.

' Tisher and Ohio Representatives Judy B. Sheerer, Ronald J. Suster.

Section 3: That it is hereby found and determined that all formal actions of this Council, concerning and relating to the passage of this resolution were adopted in an open meeting of jthis Council, and that all deliberations of this Council and of conunittees on or after November 28, 1975, that any of its

in such formal action, were in meetings open to the public in compliance with all legal requirements, including Section 121.22 of the Ohio Revised Code.

Section 4: That this Resolution shall take effect and be in force from and after the earliest period allowed by law and upon the signature of the Mayor.
