SUBJECT:

DOE /NRC MANAGEMENT MEETING CONCERNING A LICENSING SUPPORT SYSTEM DOE and NRC staff met at the NRC Silver Spring Office on Tuesday, January 14 as a follow-up to the January 9, 1986,_ meeting (meeting summary enclosed) to discuss developr.ent of a licensing Support System that would be used by DOE, NRC, states, and Indian tribes.

Joe Bunting, Phil Altomare, and Avi Bender of NRC and Ralph Stein and Charlie Head from DOE were in attendance.

Agreements reached concerning development of a Licensing Support System and the formation of a DOE /NRC coordinating committee are enclosed.

A first meeting of the coordinating committee is planned to be held in mid-February.

DOE /NRC Management Meeting January 9, 1986 BACKGROUND Charles Head, Phil Altomare and Avi Bender met in a short meeting.

(10:00 to 12:00 AM) at the DOE offices in the Forrestal building, Washington, D. C. on January 9, 1986 to discuss interactions between the NRC and DOE on a syst.em to collect, store and retrieve information for repository licensing.

Specifically, the possibility of establishing an interagency coordinating committee was discussed.

DISCUSSION The possible functions and makeup of a coordinating committee was discussed, including the identification of system requirements, coordination of activities, exchange of information and review and advisory role.

Also briefly discussed were different areas of responsibility for system development, the'NRC offer for DOE participation in the NRC pilot project, and possible negotiated rulemaking related to records management.

AGREEMENTS It was agreed that development of a coordinating committee should be pursued further, and that representatives of DOE and NRC will attempt.to hold a follow up meeting on Monday, January 13, 1986 to continue the discussions.

Possible points for Rusche/ Davis to report to the NRC Commissioners (alternatively, possible points of agreement between DOE and NRC relative to proceeding with development of the Licensing Support System (LSS):

DOE and NRC have concluded that.a joint effort is required to l

develop a licensing document management system to accomplish a three year or shorter licensing hearing for-a high level radioactive waste repository as mandated by the Nuclear Waste Policy Act of 1982.

(DOE has requested a 27 month licensing hearing.)

The LSS would be used by DOE, NRC, the states, Indian j

tribes, and other parties to the repository licensing hearings.

The goal is to make documents and other information pertinent to repository licensing available well before the license application is submitted, thus reducing the need to rely on discovery.

3.

A Coordinating Committee will be established to facilitate development of the LSS.

Initially, membership will~ consist j

of DOE and NRC staff, but the aembership is planned to be expanded to include a state and an Indian tribe i

representative.

4.

DOE will have the responsibility of designing and implementing the LSS, incorporating on-line, full text storage and retrieval ~ techniques.

NRC will participate jointly with DOE in defining the requirements for and j

procedures for operpaion of the system.

5.

All organizations using the LSS wil1 be_ responsible for following a mutually agreed upon specification defining the

' requirements for providing data entry to the system.

This specification will cover topics such as the scope of and completeness of information to be provided to the system, timeliness for providing the information, quality control of the information provided to the system, the procedures to be used to collect the information to ensure that all appropriate information is collected, and the format of the information.

DOE supports NRC's efforts in considering a negotiated rulemaking for licensing records management to facilitate the hearing process.

Topics that could be considered in such a negotiated rulemaking include:

a.

Standard format for input to the LSS (bibliographical information and ADP format);

b.

Provisions for joint use of the LSS by all parties to the repository licensing hearings (with DOE serving as the LSS operating agency); and c.

Requirements for document discovery to be conducted through the LSS data' base.

NRC will carry out a pilot project to demonstrate document storage and retrieval capabi'lities and to develop processes i

that could lead.to an interim system for use within the NRC (and possibly by others) until the full LSS is implemented by DOE.

The experience gained from the pilot project will be made available to DOE for use in expediting the definition of requirements for the LSS.

Elements of the LSS that ehet are developed by DOE and accepted by the other parties to the LSS will be integrated into the NRC pilot project for trial operation, to the extend allowed by the NRC' pilot project budget and schedule, and system capability.

The NRC will provide on line access to the pilot project by DOE.

fostering more detailed coordination, representatives of the states (in which an exploratory shaft is being constructed),

associated Indian tribes, and other parties who are very likely to be involved in the licensing hearings (and technical experts within DOE and NRC if needed) could be added.

The NRC and DOE representatives to the committee would be the first line supervisors in each organization who are responsible for system development and operation.
