Dear Licensing Board Members:
In accordance with the proposed schedule in " Motion To Esta-blish Schedule For Hearings" (October 15, 1985), which was sup-ported by all parties, Florida Power & Light Company (Licensee) hereby submits " Licensee's Motion For Summary Disposition Of
" Contention 3" (January 23, 1986).
In support of this Motion, Licensee is also submitting " Licensee's Statement Of Material Facts As To Which There Is No Genuine Issue To Be Heard With Respect To Contention 3" (January'23, 1986) and Affidavit of Dr. Stanley E. Turner on Contention 3 (January 17, 1986).
As is demonstrated in the Motion, there is no genuine issue of mater-ial fact regarding-the Contention 3, and the Licensee is entitled to a decision as a matter of law.
Accordingly, Licensee requests that the Licensing Board grant Licensee's Motion and dismiss this proceeding.
