In compliance with the provisions of the Federal Water Pollution Control Act and pursuant to the State Water Control Law and regulations adopted pursuant thereto, VEPC0 & OLD DOMINION ELECTRIC COOPERATIVE is authorized to discharge from a facility located at Lake Anna off State Route 700, Louisa County, Virginia to receiving waters named Lake Anna and North Anna River, Section 3, York River Basin, Class III, Special Standards: None in accordance with the effluent limitations, monitoring requirements, and other conditions set forth in this permit.
2.
Design and operation of facilities and/or treatment works and disposal of all wastes shall be in accorisnce with the application filed with the State Water Control Board anc; in conformity with the conceptual design, or the plans, specifications and/or other supporting data approved by the Board. The facilities shall be operated in accordance with the conditions of the permit.
3.
The approval of the treatment works conceptual design or the plans and specifications does not relieve the permittee of the responsibility of designing and operating the facility in a reliable and consistent manner to meet the facility performance requirements in the permit.
If facility deficiencies, design and/or operational, are identified in the future which could affect the facility performance or reliability, it is the responsibility of the permittee to correct such deficiencies.

Debris collected on the intake trash racks shall not be returned to the waterway.
2.
There shall be no discharge of polychlorinated biphenyl transformer fluids to navigable waters that originate from this source in amounts equal to or greater than detected by EPA Test Methods specified in the Federal Register 40 CFR Part 136, Guidelines for Establishing Test Procedures for the Analysis for Pollutants.
3.
All limitations and monitoring requirements for liquid radioactive waste discharges shall be regulated by the Nuclear Regulatory Commission in accordance with regula-tions as set forth in 10 CFR Part 20 and 10 CFR Part 50.
4.
The permittee has requested alternative effluent limitations under Section 316(a).
VEPC0 will conduct a 316(a) study and will submit a demonstration report on the study. The Board approved 316(a) study plan was implemented on 1 January 1984 and shall be concluded within two years of implementation. Within 6 months of the completion of the 316(a) study, VEPC0 shall submit a draft final report to the Board.
During the 316(a) study, should serious adverse impacts develop as a result of the thermal discharge, the Board reserves the right to reopen and modify the permit as expressed in Part III.B.4 or as deemed necessary to assure adequate pro-tection of the biota in Lake Anna and the North Anna River.
5.
The permittee shall at all times provide a minimum instantaneous release from the impoundment of at least 40 cfs.
6.
The findings of fact and conditions set forth in the C1 Certificates issued by the Board on August 29, 1973, and the 21(b) certificate as amended on February 11, 1972, are incorporated herein by reference as limitations and shall continue in full force and effect. These certificates may be revised in the future. Upon the completion of any amendments, the revised certificates shall be incorporated herein by reference as specified above.
7.
In the event final water quality standards revisions are approved, the permit shall be modified by the Board or upon the request of the applicant to reflect the require-
"T ments of any such changed standards.
8.
The permittee has prepared a report which summarizes the impingement and entrain-ment information collected from the initiation of commercial operation of Unit 1 through December 31, 1983, inclusive. The report was submitted in May 1985 and preliminarily reviewed by the staff. After the summary report has been formally reviewed by the Board, the permittee will be notified of the conclusions and whether or not the Board believes that the permittee should submit a plan to reduce the
'g number of fish, eggs and larvae entrained or impinged. A modified impingement and entrainment study may also be required as a result of the review of the Summary Report and/or the remedial action, if any is deemed necessary.
9.
Temperature monitoring program shall be done on a schedule as listed below and identified in accordance with accompanying Charts #1 and f2, except for the period of time during which the 316(a) demonstration is being conducted.

1.
Temperature measurements are to be taken hourly at surface, mid depth arid bottom at Stations 1, 3, 4, 5, a 6, at a depth of 3 meters at Station 10 and at the surface only at Stations 2, 7, 8, 9, 11 and 12.
2.
Report temperature readings as listed below:
a.
Monthly maximum daily temperature in degrees celsius, b.
Mean of daily high, mean and low values in degrees celsius.
c.
Reports are to be submitted quarterly within 90 days of the end of the quarter.
B.
Quarterly Thermal Plume Survey Network as noted on Chart #2.

Temperature measurements are to be taken during daylight hours from the surface to the bottom at meter intervals at Stations A through N on Chart #2.
- 10. The permittee shall provide notification to the Board prior to the use of chlorine or other biocide for any purpose other than disinfection at the sewage treatment plants,
- 11. This permit may be modified or alternatively revoked and reissued to comply with any standard or limitation which results from the Board's current Disinfection strategy evaluation.

- 12. Semiannual toxicity tests shall be conducted on outfall 011 using Daphnia pulex and fathead minnow, Pfmcphales pronclas.
The Daphnia test shall be a 48-hour static test and the fathead minnow test shall be a 96-hour static test, both conducted in such a manner and at sufficient dilutions for calculation of a valid LC50.
If a-test results in an LC50 of less than 100%, then further toxicity testing may be required. Technical assistance in developing the pro-cedures for these tests shall be provided by the State Water Control Board staff and all procedures shall be approved by the staff.
- 13. Annual toxicity tests shall be conducted on Outfall 010 using Daphnia pulce and the fathead minnow, Pimephales promelas.

Description:
The modification consists of revisions to several special conditions, revision of several monitoring frequencies and elimination of an incorrect state-ment concerning heat rejection rate for Outfall 010.
Special Condition #4 is being revised to allow 6 months rather than 3 months for preparation and sub-mission of the final report. During the 316(a) study several modifications were suggested by the Technical AdvisoryCommittee(TAC)andsubsequentlycarriedout by VEPCO. The TAC agreed to allow VEPC0 an additional 3 months to prepare and analyze the new data.
Special Condition #8 has been revised to indicate that the impingement and entrainment report has been submitted but that the review by the Agency has not been completed.
Since reissuance of this pennit, the wording of the chlorine reopener has been modified. Special Condition
- 11 has been revised to reflect the current disinfection language. The monitoring frequency at Outfalls 001, 002 and 009 have been reduced to 1/ month, to more accurately reflect the method of flow measurement.
These outfalls employ timers and a summation of run time to calculate average flow. The final changes are to Outfall 010. An incorrect statement concerning the calculation of heat rejection was included in the

reissued pemit. This statement has been removed.
The actual method of calculation of the heat rejec-tion rate was submitted to the Agency and approved in 1975 and was not accurately defined by the prev-fous definition. Also, the temperature monitoring requirement for this outfall will be removed for the duration of the 316(a) study and until a recommenda-tion concerning the final limitation is made.
Public Notice:
The pemit modification has received public notice in accordance with Regulation 6 and no response was received.
EPA Comments:
EPA commented that the Board should require suffic-ient information to be able to detemine whether or not the waste heat treatment facility (WHTF) is being properly operated. EPA stated that VEPC0 should be required to continue to monitor and report heat re-jection rate at Dike 3.
Finally, EPA recommended that VEPC0 be required to monitor and report the heat re-jected to and from the WHTF.
The staff believes that the proposed permit and any permit conditions that may result from the 316(a) study will be adequate to determine proper operation i
of the facility.
VEPC0 has never reported the heat rejection rate from Dike 5, so such a requirement would be a new requirement rather than a continuation of an existing monitoring condition. Because the discharge from Dike 3 is submerged, flow measurement is not practical and the calculation of a heat rejec-tion rate would not be feasible. Therefore, the staff proposes to continue the current monitoring program until the 316(a) study recommendations are receivcd.
The pemit will be modified as necessary, following review and adoption of the study results.

The modification was discussed with Dr. Richard Collins, Director of the Institute for Environmental Negotiations and copies of the proposed permit pages were provided to the Technical Advisory Comittee (TAC). The TAC had no objections to the modifications.
NPDES Permit Number VA 0052451 was issued on 2 June 1977, expired on 2 June 1982, was administratively continued and subsequently reissued on 19 March 1985.
