Considerations for Resuming FOF Inspections during the Public Health Emergency (PHE)

Date of Meeting: Tuesday, May 12, 2020 Location: Teleconference Type of Meeting: Closed Purpose of the Meeting: The purpose of this meeting was to have discussions with the Nuclear Energy Institute (NEI) and industry stakeholders regarding considerations and protocols for resuming NRC-conducted force-on-force inspections.

NSIR staff hosted a closed meeting with representatives from NEI, NextEra, Entergy, and the Union of Concerned Scientists (UCS) to discuss considerations for resuming force-on-force (FOF) inspections. During the meeting, licensees and industry representatives expressed concerns related to resuming certain FOF inspection activities, given the anticipated duration of

2 social distancing measures in place to protect the health of security personnel. NSIR staff discussed alternative approaches that could be used to assess licensee security program performance during the public health emergency, should FOF inspections continue to be delayed. NRC staff also identified that multiple factors would be considered in making decisions regarding the resumption and prioritization of inspection activities, including state, local, and site-specific conditions.

Summary of Presentation:

During this meeting the NRC provided a brief overview of the current infrastructure for FOF inspections and discussed the flexibility that has been extended to licensees by the NRC in response to the COVID-19 public health emergency. NRC staff then explained some of the options for continued evaluation of licensee performance that have been discussed, including resumption of FOF inspections, abbreviated or delayed FOF inspections, and other near-term oversight measures. Industry representatives then explained current protocols in place among the licensee population for personnel health and safety and the current approaches to conducting performance-based evolutions. Finally, NRC staff and industry representatives had an open discussion on industry concerns regarding the resumption of FOF exercises and the potential difficulties created. NRC staff and industry representatives also discussed the extent to which aspects of the FOF inspection could be conducted while retaining currently in-place social distancing measures. Dr. Ed Lyman of UCS spoke and encouraged NRC to fully weigh the statements made by industry regarding the challenges associated with the conduct of inspections with the need to conduct oversight activities, especially given the exemptions that are being granted to provide relief to licensees from regulatory requirements.

Sabrina Atack closed the meeting by opening the floor for discussion and related questions to all participants.
