OF THE MAY 14, 2020, CATEGORY 1 PUBLIC TELECONFERENCE WITH NUSCALE POWER, LLC TO DISCUSS NUSCALES GENERAL DESIGN CRITERIA 33 EXEMPTION - REACTOR COOLANT MAKEUP OF THE DESIGN CERTIFICATION APPLICATION On May 14, 2020, representatives from the U.S. Nuclear Regulatory Commission (NRC) and NuScale Power, LLC (NuScale), held a Category 1 public teleconference meeting to discuss NuScales General Design Criteria (GDC) 33 Exemption (Reactor Coolant Makeup of the NuScale Design Certification Application). Participants included personnel from the NRC, NuScale, and one member of the public.
The public meeting notice can be found in the Agencywide Documents Access and Management Systems (ADAMS) under Accession No. ML20134J037. This meeting notice was also posted on the NRC public website located at https://www.nrc.gov/reactors/new-reactors/design-cert/nuscale/documents.html.

On May 14, 2020, NRC staff held a public meeting with NuScale to understand their position associated with an observed conflict in the scope of break sizes considered in their Chapter 15 accident analysis with respect to very small breaks and leaks that are being reviewed as part of NuScale recent Design Certification Application changes.

NRC staff discussed how NuScales revised licensing approach does not appear to align with their GDC 33 exemption which states that their emergency core cooling system mitigates all break sizes. As a result of the public meeting, NuScale agreed to engage in additional discussions to develop a path forward. The staff will engage with NuScale further on this topic and will continue to evaluate the impact that this complex design change will have on the overall review schedule.
At the end of the teleconference, NRC staff solicited the public for input. The one member of the public on the bridge line responded and asked staff to summarize the GDC 33 exemption issue. The NRR technical branch chief summarized the issue to the satisfaction of the public participant.
