WE APPRECIATE THIS OPPORTUNITY TO APPEAR'6EFORE YOUR SUBCOMMITTEE TODAY TO PROVIDE THE COMMISSION'S VIEWS ON A NUMBER OF ACTIVITIES IN THE NATIONAL HIGH-LEVEL WASTE MANAGEMENT PROGRAM.

AS WE UNDERSTAND IT, THE SUBCOMMITTEE WOULD LIKE US TO COVER:

THE STATUS OF OUR ACTIVITIES UNDER THE NUCLEAR WASTE POLICY ACT; OUR VIEWS ON THE DEPARTMENT OF ENERGY'S MISSION PLAN FOR THE CIVILIAN RADIOACTIVE WASTE MANAGEMENT PROGRAM; THE ENVIRONMENTAL PROTECTION AGENCY'S RCCENTLY PROMULGATED STANDARDS ON HIGH-LEVEL WASTE DISPOSAL; NRC EFFORTS TO REFINE THE DEFINITION OF HIGH-LEVEL WASTE, AND OUR ACTIVITIES CONCERNING THE TRANSPORTATION OF SPENT FUEL.

CONCERNING YOUR FIRST AREA 0F INTEREST, THE STAFF MAINTAINS AN ONGOING UPDATE OF THE STATUS OF NRC ACTIVITIES UNDER THE NWPA, AND NRC'S ROLE IN THESE ACTIVITIES.

I WOULD LIKE SIMPLY TO ENTER OUR MOST CURRENT STATUS UPDATE INTO THE SUBCOMMITTEE'S RECORD OF THIS i

HEARING.

AMONG OTHER THINGS, THIS UPDATE COVERS ALL OF THE ACTIVITIES ON WHICH YOU HAVE ASKED US TO COMMENT IN DETAIL, AND I WILL DISCUSS EACH OF THEM IN TURN.

CURRENT EFFORTS FOR IMPLEMENTATION OF THE NWPA CONSIST OF OUR FRE-LICENSING INTERACTIONS WITH DOE, IN ORDER TO PROVID5 FOR AN EFFECTIVE AND EFFICIENT LICENSING PROCESS FOR THE GEOLOGIC REPOSITORY, NRC IS CONTINUING ITS PROGRAM TO: DEVELOP GUIDANCE ON METHODS FOR DEMONSTRATING COMPLIANCE WITH PERFORMANCE OBJECTIVES; PROVIDE GUIDANCE TO ASSURE THAT THE DOE PROGRAM PROVIDES ESSENTIAL AND ACCEPTABLE DATA WITHOUT COSTLY DELAY OR REWORK; PROVIDE ONSITE OVERVIEW OF DOE ACTIVITIES; IDENTIFY POTENTIAL LICENSING ISSUES FOR DOE ACTION; AND PROVIDE APPROPRIATE AND TIMELY REVIEW AND EVALUATION OF NWPA REQUIRED DOE SUBMITTALS SUCH AS THE ENVIRONMENTAL ASSESSMENTS AND THE MISSION PLAN.

THE NRC HAS CAREFULLY REVIEWED PRIOR DRAFTS OF DOE'S MISSION PLAN AND PROVIDED COMMENTS TO DOE, I WILL SUMMARIZE THE COMMISSION'S PRINCIPAL OBSERVATIONS AS THEY RELATE TO THE FINAL MISSION PLAN.

FIRST, AS YOU KNOW, INADEQUATE IMPLEMENTATION OF FULLY DOC'JMENTED QUALITY ASSURANCE PROGRAMS COULD CAUSE PROBLEMS IN THE TIMELY l

, i LICENSING OF A REPOSITORY.

WE ARE THEREFORE ENCOURAGED THAT IN THE FINAL MISSION PLAN, DOE IS COMMITTED TO HAVING A QUALITY I

ASSURANCE PROGRAM IN PLACE AND IMPLEMENTED BEFORE BEGINN!hG SITE CHARACTERIZATION.

WE RECOGNIZE THAT THE DETAILED IMPLEMENTATION OF THIS PROGRAM, AS CARRIED OUT BY DOE AND ITS CONTRACTORS, WILL TAKE TIME.

NRC WILL CONTINUE TO ANALYZE THIS CRITICAL UNDERPINNING OF DOE'S PROGRAM AS IMPLEMENTATION PROCEEDS.

SECOND, THE NRC IS COMMITTED TO IDENTIFYING AND MONITORING MAJOR LICENSING QUESTIONS SUFFICIENTLY EARLY IN THE PRE-LICENSING PERIOD SO THAT DOE CAN RESOLVE OUR COMMENTS WITHOUT DELAYING EITHER DOE'S i

ACTIVITIES OR THE NRC LICENSING PROCESS.

OUR COMMITMENT IS 1

LAPGELY CONTINGENT ON DOE'S IDENTIFYING AREAS WHERE CONSULTATION IS NEEDED AND ARRANGING MEETINGS WITH US EARLY IN THE PLANNING PROCESS IN SUFFICIENT TIME SO THAT NRC COMMENTS ARE INCLUDED IN DOE PLANS AND PRCGRAMS BEFORE DOE DECISIONS AND COMMITMENTS ARE l

THIRD, THE REFERENCE MISSION PLAN SCHEDULE ALLOWS 27 MONTHS FOR NRC TO CONSIDER AN APPLICATION FOR CONSTRUCTION AUTHORIZATION.

THE COMMISSION IS COMMITTED TO MAKING THE LICENSE REVIEW AS EFFICIENT AS POSSIBLE.

HOWEVER, WE CONTINUE TO BELIEVE THAT THE y

. THREE YEARS (36 MONTHS) PROVIDED BY THE NUCLEAR WASTE POLICY ACT IS A VERY OPTIMISTIC ESTIMATE FOR THE TIME REQUIRED, AND THAT EVEN THIS DEPENDS ON THE SUBMITTAL OF AN ACCEPTABLE, COMPLETE APPLICATION OF HIGH QUALITY.

WE HAVE IDENTIFIED NO SPECIFIC ACTIONS WHICH COULD PERMIT THE LICENSE REVIEW PERIOD TO BE REDUCED FROM THE STATUTORY 36 MONTHS.

WE INTEND TO CONTINUE OUR EFFORTS TO WORK WITH DOE ON WAYS TO MAKE THE LICENSING PROCESS AS EFFICIENT AS POSSIBLE, CONSISTENT WITH OUR REGULATORY RESPONSIBILITY.

THERE REMAINS THE QUESTION OF THE TIMING OF DOE'S PRELIMINARY DETERMINATION UNDER SECTION 114(F) 0F THE ACT, AS STATED IN THE MISSION PLAN, DOE INTENDS TO MAKE THE PRELIMINARY DETERMINATION REQUIRED BY THE ACT AT THE TIME THREE SITES ARE RECOMMENDED TO THE PRESIDENT FOR CHARACTERIZATION RATHER THAN AFTER COMPLETION OF SITE CHARACTERIZATION.

THIS WAS A MATTER RAISED DURING THE COMMISSION'S CONCURRENCE PROCESS ON THE DOE SITING GUIDELINES.

IN THE NRC COMMENTS ON THE DRAFT MISSION PLAN, IT.WAS STATED THAT THE MISSION PLAN SHOULD BE REVISED TO REFLECT THE NRC AND DOE AGREEMENT MADE AT THE JUNE 22, 1984 COMMISSION MEETING ON THE COMMISSIONERS' CONCURRENCE DECISION ON THE DOE SITING GUIDELINES.

THIS AGREEMENT STATED, "...THAT THE PRELIMINARY DETERMINATION SHOULD BE MADE AFTER THE COMPLETION OF SITE CHARACTERIZATION AND NOT AT THE TIME OF SITE NOMINATION AND RECOMMENDATION FOR CHARACTERIZATION."

THE COMMISSION HELD A PUBLIC MEETING ON SEPTEMBER 6, 1985 TO HEAR THE VIEWS OF INTERESTED PARTIES ON HOW THE COMMISSION SHOULD RESPOND TO DOE'S PROPOSED TIMING OF THE PRELIMINARY DETERMINATION.

THEREAFTER, WE RECEIVED WRITTEN VIEWS FROM SOME OF THE PARTICIPANTS.

WE ALSO CONSIDERED AN ANALYSIS BY OUR OFFICE OF GENERAL COUNSEL ON WHETHER NRC IS LEGALLY REQUIRED BY THE NWPA TO TAKE ANY ACTION NOW IN RESPONSE TO THE CHANGE IN DOE'S POSITION ON THE TIMING OF THE PRELIMINARY DETERMINATION.

ON OCTCBER 16, THE COMMISSION DETERMINED THAT DOE'S MODIFIED POSITION REGARDING THE TIMING OF THE " PRELIMINARY DETERMINATION" WAS NOT A NECESSARY CONDITION FOR NRC'S PRIOR CONCURRENCE IN THE DOE SITING GUIDELINES.

ON OCTOBER 24, 1985, WE CONVEYED OUR CONTINUED CONCURRENCE ON THE GUIDELINES IN A LETTER TO DOE.

WE HAVE ALSO REQUESTED THE STAFF TO PREPARE FOR COMMISSION REVIEW AN APPROPRIATE PUBLIC STATEMENT TO BE ISSUED TO RESTATE THE COMMISSICN'S CONCURRENCE IN THE GUIDELINES.

. COMMISSIONER ASSELSTINE DISAGREES WITH THE COMMISSION'S POSITION ON THE TIMING OF THE PRELIMINARY DETERMINATION.

HE BELIEVES THAT DOE MUST E THER CONFORM TO THE AGREEMENT ON THE TIMING OF THE PRELIMINAPY P?iERMINATION WHICH IS CONTAINED IN THE NRC'S CONCURRENCE DECISION ON THE DOE SITE SELECTION GUIDELINES, OR SUBMIT FOR COMMISSION CONCURRENCE A FORMAL REQUEST TO MODIFY THE SITE SELECTION GUIDELINES TO INCORPORATE DOE'S NEW POSITION ON THE TIMING OF THE PRELIMINARY DETERMINATION.

HE WILL PROVIDE ADDITIONAL COMMENTS CN THIS ISSUE SEPARATELY.

AS YOU ARE AWARE, DOE IS NCW EVALUATING PLANS TO INCLUDE THE MONITORED RETRIEVABLE STORAGE (MRS) FACILITY AS AN INTEGRAL ELEMENT OF ITS PREFERRED HIGH-LEVEL WASTE MANAGEMENT SYSTEM.

NRC STAFF HAS BEEN CAREFULLY OBSERVING AND REVIEWING DOE'S DEVELOPMENT OF ITS PROPOSAL TO CONGRESS CONCERNING THE MRS.

WE HAVE LIMITED OUR INTERACTION TO THOSE ASPECTS OF THE MRS THAT HAVE REGULATORY SIGNIFICANCE.

SHOULD CONGRESS DECIDE TO AUTHORIZE THIS APPROACH, THE NECESSARY REGULATORY FRAMEWORK WILL BE AVAILABLE ON A SCHEDULE CONS.-~5NT WITH THE MISSION PLAN.

BEFORE LEAVING THE SUBJECT OF THE MISSION PLAN, LET ME REITERATE THAT THE NRC'S ABILITY TO COMPLETE ACTIONS ON SCHEDULE IS

DEPENDENT ON DOE EFFORTS TO DEVELOP THE INFORMATION NEEDED TO RESOLVE TECHNICAL QUESTIONS, MAINTAIN HIGH QUALITY TECHNICAL PROGRAMS, AND PREPARE HIGH QUALITY LICENSING SUBMITTALS.

DOE PLANS TO REQUIRE ~ALL CASKS USED TO TRANSPORT COMMERCIAL SPENT FUEL UNDER NWPA TO BE CERTIFIED BY THE NRC, AND WILL ASSURE THAT THE TRANSPORTATION VEHICLES MEET ALL D0T REQUIREMENTS.

NRC HAS BEEN AND WILL CONTINUE TO BE INVOLVED IN A NUMBER OF TRANSPORTATION-RELATED ACTIVITIES BEARING ON THE IMPLEMENTATICN OF DOE'S NWPA RESPONSIBILITIES.

WE UNDERSTAND THAT YOU ARE ALSO INTERESTED IN NRC'S VIEWS ON S. 1162, THE BILL INTRODUCED BY SENATOR HART TO REQUIRE DETAILED ASSESSMENTS OF THE EFFECTS OF HLW TRANSPORTATION ON STATES WITH POSSIBLE SHIPMENT ROUTES.

SINCE THE BILL ADDRESSES DOE RESPONSIBILITIES, WE WOULD ONLY NOTE THAT IT WOULD HAVE LITTLE DIRECT IMPACT ON NRC.

THE NRC RECENTLY SPONSORED A THREE-DAY SEMINAR WITH THE DEPARTMENT OF TRANSPOPTATION ON SPENT FUEL TRANSPORTATION ISSUES.

THE SEMINAR WAS WELL ATTENDED BY STATE AND LOCAL GOVERNMENT AND INDIAN TRIBE REPRESENTATIVES.

IT PROVIDED AN OPPORTUNITY FOR THESE OFFICIALS TO DISCUSS THE VARIOUS WASTE TRANSPORTATION ISSUES WITH NRC AND DOT REPRESENTATIVES.
