Enclosed for your information is a copy of a December 6,1985 letter from the NRC Staff to Florida Power and Light Company (Licensee) which relates to the amendment allowing expansion of the spent fuel. pool storage capacity.

The Staff's letter is in response to a Licensee letter dated November 13, 1985 (also enclosed) indicating that Licensee has withdrawn its request for NRC review of a reanalysis of the spent fuel rack modules with fuel loaded only in the overhanging rows. The Staff states that administrative controls initiated prior to fuel loading in the affected racks preclude any fuel rack lift-off during a seismic event and that the technical analysis supporting the amendment and the conclusions in the Staff's Safety Evaluation remain valid. Consequently, the Staff will take no further action on Licensee's initial request.

parties. Copies of Licensee's original request for NRC Staff review were sent to the Board and parties by letter of Staff counsel, dated February 28, 1985, and more recently by letter of Licensee counsel, dated November 18, 1985.

SPENT FUEL STORAGE FACILITY By letter dated November 13, 1985, you have withdrawn your February 1, 1985, request for NRC review of a reanalysis of the spent fuel rack modules with only overhanging rows loaded with fuel. You further indicated that fuel placement in the new spent fuel racks will be controlled in accordance with the bases supporting amendments 111 and 105 to the operating licenses for the Turkey Point Plant Units 3 and 4. respectively, as stated in your February 1, 1985, letter.

l As indicated in our letter of February 26, 1985, the NRC staff's Safety Evaluation and supporting Technical Evaluation Report conclusions in support of amendments 111 and 105 remain valid due to the administrative controls initiated when you

? became aware of the potential need for the controls. These controls, which were initiated prior to any fuel loading in the affected racks, preclude the possibility of any separation of the rack modules from the pool liner floor during a seismic event. You have indicated that any changes will be reviewed in accordance with the provisions of 10 CFR 50.59. Should your review indicate that a technical specification change is required or an unreviewed safety question exists, you will request NRC review and approval in accordance with 10 CFR 50.59(c).

Therefore, based on the above, we will take no action on your initial request and close out the above referenced TAC numbers.

By letter dated February 1,1985, FPL requested WC review of a reonalysis of the spent fuel rock modules with only overhonging rows fooded with fuel. Mr. D. -

G. Mcdonald's letter of February 26,1985 stated that the FPL request for review (

of the reonalysis represented a change in a basis supporting Amendments lII and 105 to the operating licenses for Turkey Point Units 3 and 4 respectively, and that FPL could make such changes without prior WC approval provided that a review performed in accordance with the provisions of 10 CFR 50.59 determined that neither on explicit technical specificotton change nor on unreviewed safety question is involved.

On the basis of Mr. Mcdonald's letter, FPL withdrows its February I,1985 request. As stated in our February I letter, fuel placement in the new spent fuel rocks will be controlled in occordonce with the bosis supporting Amendments li t and 105. Any change to that basis will be reviewed in accordance with the provisions of 10 CFR 50.59. Should a 10 CFR 50.59 review indicate that a i technical specification change is required or on unreviewed safety question exists, s FPL will request tEC approval in occordonce with 10 CFR 50.59(c).
