Potential Disposal of Grace Energy Tailings at Naturita UMTRA Title I Disposal Cell j

Dear Mr. Deckler:

I am responding to your December 26, 1996, letter to me concerning the disposal of some 11e.(2) byproduct material originating at three sites in New Mexico.

These three sites were under license to Micheal P. Grace who is now deceased. His estate is currently looking for ways to cost effectively cleanup the sites, and dispose of the material. As you correctly note in your letter, there was some consideration being given to placing the lle.(2) byproduct material from the Grace sites in the Uravan cell being constructed for disposal of material under Title I of the Uranium Mill Tailings Radiation Control Act (UMTRCA).

The UMTRCA Title I material intended for the Uravan cell is from the Naturita, Colorado mill site.

The Uravan cell was one of several sites being considered for the possible disposal of the Grace 11e.(2) material. However, since receipt of your letter, I have been informed by Mr.

John Inda11, the attorney for the Grace estate, that another site has been selected for the disposal. Therefore, the Uravan cell is no longer an option.

I would like to note that the information you provided in your letter is the type of information that I was hoping to identify when we initiated our discussions with you.

In fact, the whole purpose of our initial call was to open a dialogue with the State of Colorado to help understand what additional actions would be needed to help ensure that the State of Colorado was involved i

in the process. The information you provided was helpful in understanding what needed to be done.

It would have been very useful to Mr. Inda11 and the U.S. Department of Energy in ensuring that any applicable State of Colorado requirements, including the need for public participation, got included in the project scope.
