CONFIRMATORY ORDER MODIFYING LICENSE (EFFECTIVE IMMEDIATELY)
This is to inform the Commission that a Confirmatory Order Modifying License, effective immediately upon issuance, will be issued on or about January 13.
1997, to NDC Systems. The action is based on a Severity Level III violation involving a willful failure to package. prior to export, gauging devices containing americium-241 in accordance with the Department of Transportation requirements.
The Order requires that NDC:
(1) retain the services of an independent consultant to perform two audits of its activities; (2) submit to the NRC, for i
NRC review and approval, the name and cualifications of the consultant it proposes to use in conducting these aucits: (3) provide classroom training consistent with the training requirements of 49 CFR Part 172: and (4) provide the NRC with a copy of both audits reports, including a description of the actions taken or planned in response to any recommendations, comments, or findings in the audit reports.
In accordance with the Enforcement Policy, a base civil penalty in the amount of $2.500 is considered for a Severity Level III.
However, in light of the issuance of the Order, the NRC is not proposing a civil penalty in this case.
