Comments of Commissioner Rogers on SECY 96-96-249 I concur with the comments of Chairman Jackson and Commissioner l

I also believe that there remains an issue regarding exemption requests that requires further Commission consideration.

The issue is how the Commission could identify unnecessarily onerous

regulatory requirements in the absence of a significant number of exemption. requests from such requirements.

i If licensees for some reason decide that the NRC staff has become unwilling.to act favorably on exemption requests, absent j

extraordinarily unusual circumstances, they will simply cease to apply for reasonable exemptions to inappropriate regulatory requirements. If that-occurs then the Commission will have no that should be objective way to identify regulatory requirements either eliminated or modified.

Data might appear to show a drop in exa-otion requests to e very sma]l number, but the reason for this may be obscure to the Commission.

Therefore I suggest that'the Commission ask the EDO to take steps to ensure that the comments of the Chairman and Commissioner McGaffigan (that the staff should apply regulatory criteria for exemptions objectively and without preconceived notions) are being achieved.
