DISCUSSION AND VOTE, 2:00 P.M.,

SECY-85-332A - Revised Braidwood Order The Commission, by a 4-1 vote,* approved an order requiring the applicant and staff to provide answers to Commission questions prior to a consideration by the Commission of the applicant's request that the Commission:
(1) grant an exemption from 10 CFR S 2.786 (b) (1) ; and (2) take review of ALAB-817, in which the Appeal Board denied the applicant's request that it review whether the Licensing Board committed procedural errors in the conduct of the Braidwood operating license proceedings.
Commissioner Roberts provided addition views to be attached to the order, Commissioner Asselstine disapproved and provided separate views.
(Subsequently, on December 5,1985 the Secretary signed the Order.)

- Section 201 of the Energy Reorganization Act, 42 U.S.C. S 5841, provides that action of the Commission shall be deter-mined by a " majority vote of the members present."
Commissioner Roberts was not present when this item was affirmed.
Accor-dingly, the formal vote of the Commission was 3-1 in favor of the decision.
Commissioner Roberts, however, had previously indicated that he would approve this paper and had he been present he would have affirmed his prior vote.
