December 12, 1985 g ggc 131985 MEMORANDUM AND ORDER MEMORANDUM (Period for Discovery; Motion for Reconsideration)
On December 6, 1985 TEXAS UTILITIES ELECTRIC COMPANY, et al (Appli-
- cants) requested leave to file' a. motion for reconsideration concerning the discovery -period set forth in our order of November ~ 25,- 1985,
' LBP-85-47. -_ Although we ordinarily would not grant leave-for filing of a
.e motion to reconsider a decision concerning a motion for reconsideration, we find it appropriate to grant this motion to -file because there.was one aspect of our opinion that was new.
~.
The one aspect. of our decision concerning which a motion for reconsideration is appropriate is our decision to set a new discovery
- period of 50 days.
The purpose of this new period, unexplained in our -
1 memorandum, was to permit Citizens' Association for Sound Energy (CASE) 4
- to analyze Applicants' delayed responses to discovery and to Board f
questions and to make a prompt request for follow-up information.-

To assure
'that the Board will see the link between new questions and prior responses, CASE should list one or more discovery responses for each question it asks during this new discovery _ period.
0 R D'E R For all the foregoing reasons and based on consideration of the entire record in this matter, it is this 12th day of December 1985 ORDERED:
LBP-85-47 is hereby amended so that further discovery is limited to questions designed to follow-up on information provided in response to discovery requests or Board questions. Accordingly, discovery requests should indicate what information is being followed-up by each new question asked.
Since this decision was reached prior to the filing of reply briefs, Citizens' Association for Sound Energy and the Staff of the
