APPENDIX A NOTICE OF VIOLATION Gulf States Utilities Docket No..

50-458 River Bend Station Permit:

CPPR-145 During an NRC inspection conducted on August 19-23, 1985, a violation of NRC requirements was identified.

The violation involved improper disposition of nonconformance reports.

In accordance with the " General Statement of Policy and Procedure for NRC Enforcement Actions," 10 CFR Part 2, Appendix C (1985),

the violation is listed below:

10 CFR 50, Appendix B, Criterion XVI states, in part, " Measures shall be established to assure that conditions adverse to quality.

." This requirement is addressed in Section 4.1 of River Bend Procedure QAD-16 which states, in part "

... departments shall establish and implement procedures... which provide for the identification, documentation, reporting, and correction of conditions adverse to quality."

Contrary to the above, Nonconformance and Disposition Report 12098 and Noncon-formance Reports 85NR0283 and 85NR0284, which reported conditions adverse ho quality, specifically that test results did not meet test procedure criteria, were dispositioned to " accept as is" based on the unproven possibility that test instrumentation was inaccurate.

This is a Severity Level IV violation (Supplement II.D) (458/8559-01).

Pursuant to the provisions of 10 CFR 2.201, Gulf States Utilities is hereby required to submit to this office within 30 days of the date of the letter transmitting this Notice, a written statement or explanation in reply, including for each violation:

(1) the reason for the violations if admitted, (2) the corrective steps which have been taken and the results achieved, (3) the corrective steps which will be taken to avoid further violations, and (4) the date when full compliance will be achieved.

Where good cause is shown, consideration will be given to extending the response time.
