THERMAL SCIENCE, INC. - NOTICE OF VIOLATION

Dear Mr. Schaeffer:

This is in response to your letter dated October 7, 1996, where Thompson Coburn requests copies of the transcript of the criminal proceeding against Thermal Science, Inc. (TSI).

Your letter indicates that copies are required in order to respond to the Notice o# Violation and Proposed Imposition of Civil Penalties (Notice) sent to y~u ui October 1, 1996.

Copies are available and can be obtained friri the court reporter, Jacqueline Sovich at (301) 345-5933.

In addition, your October 7, 1996, letter requests a 60-day extension in which to respond to the Notice, as given the length of the criminal trial (three months), your firm estimates additional time will be required to draft an adequate response. We do because Mr. Gordon Ankney,not consider an additional 60-days to be reasonable, of your firm represented TSI in the criminal trial and is presumed to be knowledgeable on the matters that are the subject of the Notice.

Accordingly, a lengthy delay would not be. warranted; however, NRC agrees that a request for a 30-day extension would not be unreasonable.'

Accordingly, NRC grants an extension of 30-days, making TSI's response due 60-days from the date of the Notice.

In accordance with 10 CFR 2.790 of the NRC's " Rules of Practice," a copy of this letter will be placed in the NRC Public Document Room.
