Virginia Electric and Power Company (North Anna, Units 1 and 2)

PROPOSED IMPOSITION 0F CIVIL PENALTY - $20,000 This is to inform the Commission that a Notice of Violation and Proposed Imposition of Civil Penalty in the amount of Twenty Thousand Dollars will be issued on or about December-13, 1985 to Virginia Electric and Power Company.
This action is based on a Severity Level III violation involving the falsification of records regarding deficiencies in the application of unqualified protective coatings in the Units 1 and 2 reactor containment buildings between December 1982 and May 1983 at the North Anna facility.
The base civil penalty of $40,000, the amount for a Severity Level III violation at the time the violation occurred, has been mitigated 50% because of the licensee's corrective actions once it became aware of the falsified records.
Enforcement action is being taken notwithstanding the amount of time that has elapsed since the violation because of the significance of any violation involving falsification of quality assurance records.
It should be noted that the licensee has not been specifically informed of the enforcement action. The Regional Administrator has been authorized by the Director, Office of Inspection and Enforcement, to sign this action. The schedule of issuance and notification is:
Mailing of Notice December 13, 1985 Telephone Notification of Licensee December 13, 1985 A news release has been prepared and will be issued about the time the licensee receives the Notice.
The State of Virginia will be notified.
The licensee has thirty days from the date of the Notice in which to respond.
Following NRC evaluation of the response, the civil penalty may be remitted, mitigated, or imposed by Order.
