APPENDIX NOTICE OF VIOLATION Wisconsin Electric Power Company Docket No. 50-266 Docket No. 50-301 As a result of the inspection conducted August I through September 30, 1985, and in accordance with the General Policy and Procedures for NRC Enforcement Actions, (10 CFR Part 2, Appendix C), the following violation was identified:
Technical Specification 15.5.4.4 requires that: "Except for the two locations adjacent to the designated slot for the spent fuel storage rack neutron absorbing material surveillance specimen irradiation, spent fuel assembly storage locations immediately adjacent to the spent fuel pool perimeter or divider walls shall not be occupied by fuel assemblies which have been suberitical for less than one year."
Contrary to the above, on February 7,1984, fuel assemblies K09, K11 and K28 were moved to positions adjacent to the spent fuel pool east wall. These assemblies were last critical on October 1,1983, a period less than one year.
This is a severity Level IV violation (Supplement 1).
The inspection showed that action had been taken to correct the identified violation and to prevent recurrence.
Consequently, no reply to this violation is required and we have no further questions regarding this matter.
