SUBJECT: NRC INSPECTION REPORT NO. 50-440/97-02 AND NOTICE OF VIOLATION

Dear Mr. Myers:
l
On March 21,1997, the NRC completed a routine safety inspection at your Perry 1
reactor facility. The enclosed report presents the results of that inspection.
i
During this 6-week inspection period, one plant transient, involving the loss of an electrical
i
bus, impacted plant operation. Control room response to this event was appropriate and
both Engineering and Maintenance provided prompt support for troubleshooting and
restoration.
l
A violation of NRC requirements was identified. In this case, your record of a safety
evaluation required by 10 CFR 50.59, regarding a modification of the emergency closed
cooling system, did not adequately support your conclusion that the probability of a
malfunction was not increased or that the potential for a different malfunction was not
!'
introduced.
This violation is cited in the enclosed Notice of Violation, and the circumstances
surrounding the violation are described in detailin the enclosed report. Please note that
you are required to respond to this letter and should follow the instructions specified in the
enclosed Notice when propering your response. The NRC will use your response, in part,
'
to determine whether further enforcement action is necessary to ensure compliance with
.
regulatory requirements.
