Enclosed is a Synopsis from a Report.of Investigation'that documents that the President of Northwest X-Ray, Inc., knowingly and willfully violated the pro-visions of 10 CFR 150.20 by using radiographers not listed on the Idaho license. Willful violations of NRC requirements are considered by the NRC to be very serious and may result in esca}ated enforcement action.

SYNOPSIS
- On June 27, 1985, the Nuclear Regulatory Commission Region IV Office requested investigation of the suspected willful violation of 10 CFR 150.20 (concerning the reciprocity of an agreement state license) by Northwest X-Ray, Incorpor-ated, Idaho Falls, Idaho. On May 16, 1985, Northwest X-Ray submitted to NRC Region IV an NRC Form 241 requesting authorization to perform radiographic activities in Montana (a non-agreement state) under the provisions of 10 CFR 150.20. Region IV noted Northwest X-Ray was proposing the use of radiographers not listed on their Idaho license.
Region IV granted Northwest X-Ray authority to perfonn licensed activities in Montana utilizing only l
authorized radiographers identified on their Idaho license. A subsequent Region IV inspection of Northwest X-Ray activities near Cutbank, Montana, disclosed two of the three Northwest X-Ray radiographers working there were i
not identified on their Idaho state license.
On July 1, 1985, the President of Northwest X-Ray, Incorporated, admitted having knowingly and willfully violated the provisions of 10 CFR 150.20, in that he utilized two radiographers not listed on his Idaho license and not authorized by the NRC. The knowing and willful contravention of 10 CFR 150.20 violates the provisions of Section 223(a) of the Atomic Energy Act of 1954, as amended.
