j I concur with the Chairman's comments on.the issuance of proposed

regulatory guidance relating to implementation of 10 CFR 50.59 for public comment.
-I agree that following the comment period, the staff should prepare a paper for the Commission which considers the public comments on the 50.59 Proposed Regulatory Guidance and I
integrates these with the gum.ance provided by the Commission to l
the staff on Secy-97-036 and the' Millstone Lessons Learned and provides recommendations for further improvements to the regulatory process.
I also concur with the Chairman's comment and edits.
i relating to Page 1 of the proposed Federal Register Notice to make i
clear that NRC is requesting comments in Section IV, - " Policy Issues" of Secy-97-035.
J I agree with Commissioner Diaz that policy issues raised in Secy-li 97-036 that have a potential for rulemaking should be issued for j
public comment.
However, 'I do not believe it is necessary to delay the issuance for public comment of the Proposed Regulatory Guidance i

for 50.59 in Secy-97-035 to allow the issues in Secy-97-036 to be included with it.
l I furthermore concur with Commissioner Diaz's comments with respect to certain short-term and long-term Commission actions with the understanding that the short-term actions would take place after 5
consideration of the public comments received on the 50.59 Proposed 4
