CORRECTIVE ACTIONS IN RESPONSE TO GENERIC LETTER 96-06 CONCERNS FOR ST. LUCIE UNITS 1 AND 2 (TAC NOS. M96870 AND M96871)

Dear Mr. Plunkett:

By letter dated January 28, 1997, Florida Power and Light Company (FPL) submitted the 120-day response to Generic Letter (GL) 96-06, Assurance of 3

1 Equipment Operability and Containment Integrity During Design-Basis Accident Conditions, for St. Lucie Units 1 and 2.

FPL indicated that certain piping systems do not meet the criteria specified i: the Final Safety Analysis Report (FSAR). The letter indicated that St. Lucie Unit 2 is entering an outage on April 14, 1997, allowing insufficient time to restore the systems to the criteria specified in the FSAR during this outage. However, FPL considered the systems operable using the criteria of American Society of Mechanical Engineers (ASME)Section III, Appendix F.

FPL committed to submit license amendment requests to incorporate ASME Section III, Appendix F into the licensing basis of both St. Lucie units prior to restart from the subsequent Unit 2 outage, currently scheduled for the f all 1998.

GL 91-18 states that licensees may use the criteria in Appendix F of Section III of the ASME Code for operability determinations and that these criteria are valid until the next available outage of suitable duration to effect the necessary design changes to restore the system to the FSAR criteria.

In your January 28 letter you indicated that you do not intend to restore the systems in question to the design basis indicated in the St. Lucie FSAR.

As you are aware, changes to the facility as described in the FSAR may be made without prior Commission approval unless the proposed change involves a change in the technical specifications or an unreviewed safety question (USQ). There is apparently no technical specification change associated with incorporating ASME Section III, Appendix F into the St. Lucie FSAR. Since you have indicated that a license amendment is necessary, it appears that the condition may constitute a USQ.

GL 91-1C states the NRC policy that when a change involves a USQ, the licensee must obtain a license amendment prior to operating the plant with the nonconforming condition.

2 Mr. T. Plunkett In summary, since your submittal stated that a license amendment was in preparation, it appears that FPL has determined that a USQ exists for the St. Lucie units.

If so, it would not be acceptable for the units to restart from a shutdown condition until the NRC approves and issues the appropriate license amendment.
