r Dear Mr. Henker: n ThisrefErs'totheinspectionconductedonMarch 17, 1997, at your Hialeah' ! Gardens, Florida' facility. The inspection included a review of activities g where you used byproduct materials in areas under NRC jurisdiction, ie. in
- Kearny, New Jersey and Minneapolis,-Minnesota. The enclosed report documents
[ the results of this inspection.
j Areas examined during the inspection are identified in the report. Within
- these areas, the inspection consisted of selective examinatiom cf procedures
and representative records and interviews with personnel.

i ' Based on the results of this insmction, two potential violations of the NRC's ; i requirements were identified. .Tlese potential violations are being reviewed j by the NRC for further consideration and action. The potential violations are i described in Section 01 of the enclosed Inspection Report, and are associated . with the 'use of byproduct material without an NRC license by an individual ! named on your State of Florida radioactive materials license in areas of NRC i
jurisdiction. The circumstances surrounding the potential violations and the
j significance of these issues were discussed with you at the inspection exit i meeting on March 17, 1997. In the interim bafore the NRC's final resolution i of this matter, you must implement sufficient corrective actions to prevent i ' violations of NRC requirements. We request that you provide us with a
detailed written description of the actions you have completed to ensure that
,
you and other authorized users named on your Florida license comply with
. applicable.NRC requirements. We further request that you provide us with this
written description within thirty days of your receipt of this letter.
You may be contacted in the future to provide the NRC with additional
information concerning this matter so that the NRC may complete its evaluation
of these potential violations. You will be advised by separate correspondence
of the results of our deliberations on this matter.
'In accordance with 10 CFR 2.790 of the NRC's " Rules of_ Practice," a copy of
this letter, its enclosures, and any reply will be placed in the NRC Public
Document Room.
