This is in further response to your letter dated September 17, 1985, in which you requested, pursuant to the Freedom of Information Act (F0IA), copies of any documents pertaining to the historical background of 10 CFR 50.59.
The documents listed on the enclosed Appenrix B are being placed in the NRC's
, Public Document Room (POR) located at 1717 H Street, MW, Hashington, DC 20555, in PDR folder FOIA-85-640 under your name.
The document listed on enclosed Appendix C is being withheld from public disclosure pursuant to Exemption 5 of the FOIA (5 U.S.C. 55?(b)(5)) and 10 CFR 9.5(a)(5) of the Conmission's regulations. The docunent contains the NRC staff's predecisional legal analyses, opinions, and recommendations to the Comission on the issue of "No Significant Hazards Detemination" as f t relates to the repair of steam generators at the Three Mile Island Unit I nuclear plant. The release of this document would tend to inhibit the open and frank exchange of ideas essential to the deliberative process. It contains no reasonably segregable portions,and it is being withheld in its entirety.
Pursuant to 10 CFR 9.15 of the Commission's regulations, it has been deterrained that the information withheld is exempt fron production or disclosure and that its production or disclosure is contrary to the public interes t . The person responsible for the cenial is Mr. John C. Hoyle, Assistant Secretary of the Comission.
This denial may be apoealed to the Secretat*y of the Commission within 30 days from the receipt of this letter. Any such appeal must be in writing, addressed to the Secretary of the Comission, U.S. Nuclear Regulatory Commission, Washington, DC 20555, and shcuid clearly state on the envelope and in the letter that it is an " Appeal from u initial FOI4 Decision."
