i On December 13, 1995, the NRC issued a~ letter to Northeast Utilities (NU) requesting NU, pursuant to 10 CFR 50.54(f), to provide information describing actions taken to ensure that future operations of Millstone Unit I will be
- l' conducted in accordance with the terms and conditions of the Millstone Unit 1 operating license, the Commission's regulations, including 10 CFR 50.59, and the Millstone Unit 1 Updated Final Safety Analysis Report (UFSAR).

1etters were issued to NU for Millstone Unit 2 on March 7, 1996, and Unit 3 on April 4, 1996.
In those letters, we requested that the information be 3
submitted no later than 7 days prior to the restart of the respective s
Millstone units.

By letter dated May 21, 1996, we further requested, pursuant to 10 CFR 50.54(f), a comprehensive list of design and configuration deficiencies
[
identified after our December 13, 1995, 50.54(f) letter for Millstone Unit 1 and after the ACR 7007 - Event Response Team Report was issued for Millstone Units 2 and 3.
The list was to contain issues that raised questions concerning operability of required equipment and the existence of unreviewed safety questions (including deficiencies that required an evaluation to determine that there was not an operability or unreviewed safety question issue, and any other deficiency that you believe is significant).
For each deficiency to be listed, specific information was requested.
In the letter, we recognized that changes may occur based on the results of your reviews and requested that you provide updates to the lists as appropriate.
-By letter dated October 9,.1996, the NRC requested that NU provide information on how the Operational Readiress Plan and schedule of important milestones were impacted by the licensee's management reorganization.
By letter dated January 13, 1997, the NRC requested that documents similar to the Operational Readiness Plan Punchlist that was submitted for Millstone Unit 3 in NU's August 13, 1996, letter also be provided for Units 1 and 2.
The NRC also requested updates for all three units for significant changes.
The NRC has revised, as provided below, these requests for information and has determined that one letter consolidating all the information required by the staff, be written to clarify the NRC's requests. i increased and the process the NRC is using for plant restart has changed in a number of ways.
In June 1996, the NRC designated the units at Millstone as 4
Category 3 plants on the NRC's watch list. On August 14, 1996, the NRC issued i
a confirmatory order directing NU to contract with a third party to implement an independent corrective action verification program to verify the adequacy j
of its efforts to estabitsh adequate design bases and design controls. On October 24, 1996, the NRC issued an crder directing that, before the restart of any Millstone unit, NU develop and submit to the NRC a comprehensive plan i
for reviewing and dispositioning safety issues raised by its em)1oyees and i
ensuring that employees who raise safety concerns can do so wittout fear of retaliation.
In November 1996, the NRC created a new organization, the i
Special Projects Office, within the Office of Nuclear Reactor Regulation, to provide a specific management focus on future NRC activities associated with the Millstone units.
In light of these changes and the discussions at the January 29, 1997, Commission meeting, the NRC has clarified the information i
needed on the docket.
l This letter supersedes the requests contained in the previously-mentioned 10 CFR 50.54(f) letters. The NRC requires, pursuant to 10 CFR 50.54(f), the following information to be provided on the docket in the time interval indicated:

- 1. For each unit, the significant items that are needed to be accomplished prior to restart. Significant items are defined as issues impacting equipment covered by 10 CFR 50.65, " Requirements for monitoring the effectiveness of j
m & tenance at nuclear power plants," that raised (1) questions concerning operability of the equipment, or (2) questions concerning the ability of the l
equipment to perform its intended design basis function. This list should be submitted within 45 days of this letter and updated approximately every 45 l
days thereafter.
For each item, NU must include, as a minimum, a one line j
descriptive title and an identifying reference document (for example, the j
adverse condition report number).

- 2. For each unit, the list of items to be deferred until after restart. This 1
list should be submitted within 45 days of this letter and updated L
approximately every 45 days thereafter. The final list must be submitted no i
later than 14 days prior to the Commission meeting for each individual plant restart (for planning purposes, the Commission meeting will take place approximately 30 days prior to planned restart). This items list must l
include, but not be limited to, issues, impacting equipment covered by j
10 CFR 50.65, which will not be resolved or fully implemented prior to restart.
For example, this list should include design changes, work orders, i
control room deficiencies, and bypass jumpers.. For each item, NU must include, as a minimum, a one line descriptive title and an identifying i
reference document (for example, the adverse condition report number).
- 3. For each unit, the process and rationale NU is using to defer items (those i
identified in 2 above) until after restart (this would be in narrative form) should be submitted within 45 days of this letter.
