APPLICANTS' ANSWERS AND OBJECTIONS TO CCANP SECOND SET OF INTERROGATORIES TO APPLICANTS Pursuant to 10 C.F.R. $$ 2.740 and 2.740b, Applicants hereby provide their answers and objections to CCANP's second set of interrogatories to Applicants.
I. General Obiections A. Applicants object to the entire set of interrogatories, except interrogatories 12a, b and c, on the grounds that inquiry into illegal drug use at STP and the programs in place to detect such use is neither relevant to, nor reasonably calculated to lead to, the discovery of admissible evidence regarding the only issue in Phase III upon which discovery has been authorized (Issue F). As discussed in more detail in Applicants' Motion for
- Protective Order (February 17, 1985) (" Motion"), Issue F relates to whether HL&P's QA program for operation of STP will meet the requirements of 10 C.F.R. Part 50, Appendix B. Appendix B does 8602200435 e60218 W FDR ADOCK O DR G

4 not require, nor provide criteria for, licensee programs to detect and control the use of drugs by nuclear plant personnel.
Even if the wording of Issue F was less clear as to its lack of applicability to matters relating to drug use, consideration of such matters under Issue F would be impermissible since this area of inquiry is currently the subject of generic action by the Commission and is, therefore, barred from litigation in indivi-dual licensing proceedings. As discussed in more detail in Applicants' Motion at 5-6, the Commission has under consideration two proposed rules and a Statement of Policy which address the subject matter of CCANP's discovery requests.
B. In Instruction 2, CCANP states that each interrogatory response should include all pertinent information known to Applicants including their " officers, directors, or employees, their agents, advisors, or counsel." CCANP Interrogatories at 1.
The term " employees" is defined to include HL&P, Bechtel, Ebasco, "any consultants, sub-contractors, and anyone else performing work or services on behalf of the Applicants or their agents or sub-contractors." Id. Instruction 2 is unduly broad, would require Applicants to engage in extensive and burdensome investi-gation and represents an inappropriate effort to discover information from third parties.
Since the inception of STP (and even since the date when CCANP requests information regarding STP " programs" to detect drug use at STP, 12g2, January 1, 1984) there have been hundreds of contractors, consultants and sub-contractors perform-t
ing work or services for STP. Many, if not all, of these contractors and consultants have programs or policies governing the use of drugs by their employees and the terms of those programs and policies may widely vary. Moreover, information about the programs of such organizations is generally not relevant to the drug control programs that will apply to STP during plant operation. Accordingly, Applicants should not be required to provide information, beyond that in their possession, concerning contractors', consultants', or sub-contractors' programs or their employees found to have used drugs. While Applicants may properly be required to produce information in their possession (to the extent relevant to the issues to be litigated within the meaning of 10 C.F.R. 5 2.740) regarding their employees, officers, directors, counsel or contractors, instruction 2 is unduly broad and burdensome and would require Applicants to engage in a angthy investigation of the programs and policies of numerous past and present contractors that are beyond their control and from which full and complete cooperation cannot be assured.
Furthermore, such discovery represents an impermissible effort to obtain discovery from third parties in a manner not sanctioned by the Commission's rules. Those rules permit discovery against non-parties to be taken by deposition (10 C.F.R. 5 2.740a or subpoena (10 C.F.R. 5 2.720), but not through interrogatories (10 C.F.R. S 2.740b). Pacific Gas and Electric Cat (Stanislaus Nuclear Project, Unit 1), ALAB-550, 9 NRC 683,
690 (1979). CCANP's requests for information regarding the myriad contractors and consultants on the Project, to the extent such information is not in Applicants' possession, impermissibly seek to discover information from such third parties, through interrogatories directed at Applicants. Accordingly, Applicants object to this instruction.
C. CCANP also states in instruction 4, that "[t]hese interrogatories shall be continuing in nature and subject to supplementing should additional information become available."
CCANP Interrogatories at 2. 10 C.F.R. 5 2.740(e) states that
"[a] party who has responded to a request for discovery with a response that was complete when made is under no duty to supple-ment his response to include information thereafter acquired except as (provided in Sections 2.740(e)(1)-(3)]." Applicants will supplement their answers only in accordance with Section 2.740(e)(1)-(3).
D. Applicants' additional objections to specific interro-gatories are provided in the context of those interrogatories.
II. Specific Answers and Obiections i
Interroaatory 1: Please provide a detailed description l of any program in place at the South Texas Nuclear Project at any time since January 1, 1984, to detect the use and/or sale of illegal drugs by employees working on the Project.
Obiection: In addition to the general grounds for objection stated in Section I above, Applicants object to this interrogatory to the extent that it seeks information regarding programs for the detection of illegal drug use and/or sale by l
Project employees other than those programs to be implemented during Plant operation. Issue F addresses the QA program for operation of STP and discovery of past programs and policies is outside the scope of that issue.
Interrocatory 2: For eacit program described in answer to Interrogatory 1, please provide the following information:
- a. Whether the program included the use of tests, such as lie detector tests and urinalyses.
- b. For those programs including the use of tests, which employee groups were subject to such tests and which were not.
Obiection: Applicants object to this Interrogatory on the same bases as stated in objection to Interrogatory 1.
Interrocatory 3: Please provide the name, job title, and address of the employees who administered or currently administer the program or programs identified in the answer to Interrogatory 1.
Obiection: Applicants object to this Interrogatory on the same bases as stated in objection to Interrogatory 1.
Interrocatory 4: Regarding the use of lie detector tests on STNP employees, please:
- a. Specify what date lie detector tests were first given in connection with inquiries related to use and/or sale of illegal drugs by STNP employees,
- b. Provide all the dates when such tests were i
administered.

- c. For each date identified in answer to Interro-
! gatory 4b, provide the name of the company or companies per-forming the lie detector tests.
- d. For each date and company identified in Interro-1 gatory 4c, provide the names of the personnel who performed the
! tests and their employers.
- e. Provide the questions that were asked in each test given on the dates identified in answer to Interrogatory 4b.
- f. For each date identified in answer to Interro-gatory 4b, identify who made the selection of people to be tested.
- g. For each date identified in answer to Interro-gatory 4b, specify what criteria was used to select the people to be tested.
- h. For each date identified in answer to Interro-gatory 4b, provide the names of all employees who were given such tests and their positions at the time the lie detector tests were given.
- i. For each person identified in answer to Interro-gatory 4h, provide the name of the person or persons performing the test on that individual.
Obiection: In addition to objecting to the entire Interrogatory 4 on the same basis as stated in objection to Interrogatory 1, Applicants object to:
(1) Interrogatory 4(e) on the grounds that disclosure of such information would reveal confidential information, such as allegations regarding the persons taking such tests or other individuals. NRC regulations specifically exempt from public disclosure NRC records that would reveal personal information that might constitute an invasion of personal privacy, g2g., 10 C.F.R. 2.790(a)(6) and (7). In an analogous request for information from Applicants, information of this nature should not be disclosed unless the need for such information outweighs the potential detriment that would result from its disclosure.
There clearly is no need for disclosure of such information in this case.
(2) Interrogatory 4(h) on the grounds that provision of the information requested would be an unwarranted invasion of the privacy of the individuals who were tested. Additionally, Interrogatory 4(h) is unduly broad and irrelevant in requesting names of "all employees" rather than operations or operations QA personnel.
I Interroaatory 5: For each person identified in answer to Interrogatory 4h, state whether said person was considered to have passed or failed the lie detector test regarding the use and/or sale of illegal drugs. If sone evaluation category other than " pass" or " fail" was used, please specify what evaluations were used and provide the evaluation for each person identified
- in Interrogatory 4h as to the use and/or sale of illegal drugs.
Obiection: Applicants object to this Interrogatory on the same bases as Interrogatories 1 and 4(h).
Interrcoatorv 6: If a lie detector test indicated j possible or actual use and/or sale of illegal drugs, what procedure or procedures were followed to further investigate such evidence?
2 Obiection: Applicants object to this Interrogatory on the same bases as stated in objection to Interrogatory 1. In addition Applicants object on the grounds that this Interrogatory asks for investigatory techniques, the disclosure of which may impede future investigations. In an analogous circumstance NRC regulations exempt from public disclosure NRC records that would disclose investigative techniques and procedures. 10 C.F.R.
- 5 2.790(a)(7)(v). Since investigations of the type addressed in this Interrogatory are used in the safe management of STP, it would be contrary to public policy to jeopardize their future success through such disclosure.

Interroaatorv 7: If a lie detector test indicated possible or actual use and/or sale of illegal drugs, what procedure or procedures were to be followed regarding the employee tested?
Obiection: Applicants object to this Interrogatory on the same bases as stated in objection to Interrogatory 1.
Interroaatorv 8: For each person identified in answer to Interrogatory 4h whose evaluation indicated possible or actual use and/or sale of illegal drugs, please detail what subsequent <
actions, including termination, were taken and the personnel involved in taking those actions.
Obiection: Applicants object to this Interrogatory on the same bases as stated in objection to Interrogatory 5.
Interroaatorv 9: For each person terminated as a result of the lie detector tests identified in answer to Interro-gatory 4, please provide:
- a. The name, position, and employer on the Project at the time of the termination of each person terminated.
- b. The name, position, and employer of the person or persons who evaluated the results of their test.
- c. The last known address and telephone number of each person terminated.
- d. The name, position, and employer of the person responsible for their termination.
Obiection: In addition to objecting to Interrogatory 9 on the general grounds stated in Section I above, Applicants object to Interrogatories 9a and c on the same bases as stated in
{ objection to Interrogatory 5.
Interroaatory 10: For each person identified in the answer to Interrogatory 4h, identify as completely as possible any other people said person identified as possibly involved in j the use and/or sale of illegal drugs.

. I Moreover, the speculative nature of CCANP's request for the naaes of individuals identified by others as "possibly involved in the use and/or sale of illegal drugs," (emphasis added) represents an even more extreme invasion of the privacy of those individuals.
Interroaatory 11: For each person identified in the answer to Interrogatory 10, please specify what further investi-gation was conducted regarding the use and/or sale of illegal drugs by that person and specify the result of that investi-gation.
Obiection: Applicants object to this Interrogatory on the same bases as stated in objection to Interrogatory 10.
Interroaatory 12: Regarding the Operations Group at STNP, please provide the following information:
- a. The date said group was formed.
- b. The functions of said group.
- c. The names and employment history (date hired, positions held, date employment ended) of all personnel who were members of this group since the inception of the group.
- d. The identity and last known address of any member of this group terminated for reasons related in any way to the use and/or sale of illegal drugs.

Answer 12(b): The Nuclear Plant Operations Department is responsible for plant production and production support activities to ensure the safe, reliable and efficient startup, operations, maintenance and refueling of STP, including adherence to the operating license and technical specifications. Produc-tion responsibilities include operations, maintenance, technical support and chemical operations and analysis. Production support responsibilities include health and safety services, management services, outage management and public relations. These func-tions are more fully described in the testimony of Jerrold G.
Dewease (Goldberg and Dewease ff. Tr. 10548, at 5-14) which is being updated in the February 14, 1986 Affidavit of Mr. Dewease in response to the Board's January 29, 1986, Memorandum.
Answer 12fc): The attached list (Attachment A) provides the names of individuals reporting to the Plant Manager (or his predecessor, the Plant Superintendent), the dates such individuals were hired or transferred into the Nuclear Plant Operations Department, the positions held by such individuals during their tenure in the Nuclear Plant Operations Department, and the dates such individuals left the Nuclear Plant Operations Department (whether by transfer or termination of employment with HL&P).
Interroaatory_ll: Please identify any of the employees in interrogatory 4h who implicated members of the Operations Group or the Operations Group generally in the use and/or sale or illegal drugs.
