NRC STAFF MOTION FOR EXTENSION OF TIME TO RESPOND TO OCRE MOTION TO REOPEN THE RECORD TO ADMIT A CONTENTION CONCERNING THE SEISMIC DESIGN OF Tile PERRY PLANT I.
INTRODUCTION By motion dated February 3, 1986 the intervenor, Ohio Citizens for Responsible Energy (OCRE) requested the Atomic Safety and Licensing Appeal Board (Appeal Board) to reopen the record to admit a contention concerning the adequacy of the seismic design of the Perry Nuclear Power Plant (PNPP). The basis provided by OCRE for the motion is a newspaper account of the January 31, 1986 earthquake near the PNPP site.
Under the Commission's rules of practice, the response of NRC Staff (Staff) is due on February 24, 1986.
10 CFR I 2.730(c). Because this provides insufficient time for Staff and their consultants to analyze the exten-sive data obtained during and after the earthquake so as to provide an adequate technical response, the Staff seeks an extension of time to respond to OCRE's motion as set forth below.

DISCUSSION As correctly indicated by OCRE's motion, an earthquake of approxi-mately 5.0 on the Richter scale occurred near PNPP on January 31, 1986.
This event has been the subject of extensive investigation by NRC, Cleveland Electric Illuminating Company (CEI or Applicants), the United States Geological Survey (USGS) and other experts.
The plant has been inspected extensively by Staff and Applicants.
The results of these investigations and inspections comprise a large body of information not yet completely analyzed and correlated into a, omprehensive evaluation I
by the Staff.
The Applicants' full report and analyses of data obtained by seismic monitors at PNPP were submitted to Staff on February 12, 1986 so that detailed review of this data by the Staff experts in the several disciplines involved is only beginning.
The Staff intends to provide its evaluation and conclusions concerning this data in a supplemental SER about March 7, 1986.
Until that time, the Staff will not be ade-t quately prepared to provide a full and accurate response to OCRE's motion.
The Staff believes that sufficient review and evaluation will I
be completed by the several members of NRR and OIE, assigned to this task as well as the consultants who are assisting the Staff, so that a i
response can be provided to the Appeal Board on March 5,1986. Accord-ingly, the Staff requests extension until March 5,1986, to respond to l
OCRE's motion.
Staff Counsel has contacted representatives of OCRE and the Applicants concerning the Staff's request for an extension of time.
Both representatives stated they have no objection to the extension requested.
w REQUEST FOR RELIEF Base'd on the foregoing and for good cause shown, the NRC Staff respectfully requests that the time for the Staff to respond to OCRE's February 3, 1986 motion to reopen the record be extended to March 5, 1986.
