Response to Notice of Violation This is in reference to your letter of January 29, 198b, which forwarded a Notice of Violation arising from investigations of leak rate testing at TMI-l in 1978 and 1979.
That letter stated that, given the circumstances there identified, the 'NRC had concluded that no civil penalty should be proposed and that no response to the Notice was required.
i I have previously provided to you, by letter of July 20, 1984, the report of an investigation I had made of this matter.
I have no I
additional information to provide.
However, there is one error of fact in your letter.
Specifically, the statement on page two, that
" Criminal action has already been taken against GPU Nuclear for f alsifying leak rate tests at TMI-2" is not correct. The indictment and pleadings on the TMI-2 leak rate testing involved Metropolitan Edison Company, not GPU Nuclear.
