gentlemen.

This is an Affirmation /Possible Discussion 4

Session.

We have two items on the agenda and I'll'ask the 5

Secretary-to lead us through those items.

6 MR. CHILK:

Mr. Chairman, the first is SECY 86-17 7

entitled:

Final Rule, Limitation on the Use of Highly 8

Enriched Uranium, HEU, in Research and Test Reactors.

9 The. commission here is being asked to act on a final I

10 rule that amends the regulations to limit the use of highly i

11 enriched uranium fuel in domestically-licensed research and 12 test reactors.

The amendments require that the newly-licensed 13 non-power reactors use low-enriched uranium fuel; and 14 contingent on government funding, licensees of existing 15 non-power reactors replace HEU fuel with LEU fuel acceptable 16 to the Commission.

17 All Commissioners have approved the final rule as 18 presented in the SECY paper with several editorial corrections t

19 noted by the Chairman.

Commissioner Asselstine has additional l

20 views which he circulated.

The commission has also agreed 21 that the backfit rule should not be applied to this amendment

{

22 of the regulation which relates only to non-power reactors.

The Commission in this paper is being 12 asked to decide whether to take review of ALAB-826.

13 All Commissioners have approved the order with some.

14 minor modifications by the Chairman indicating that the 15 Commission has decided that the review of ALAB-826 is not 2

16 warranted.

1 17 The Commission order also provides comments on the 4

18 Licensing Board's conclusions regarding INPO accreditation 19 programs and notes that with this order, the TMI-1 RESTART 20 administrative proceeding comes to a close.

The SRM that we 21.

issued will also direct the staff to discuss with INPO the 22 questions raised by the Board with regard to INPO failing to 23 comply with its own criteria during the accreditation of the 24 TMI program.
