1 NRC STAFF RESPONSE TO LICENSING BOARD ORDER, AND r

NOTICE OF APPEARANCE #  ;

INTRODUCTION AND BACKGROUND Frank J. Calabrese Jr. was denied a Senior Reactor Operator's (SRO) License by the Staff on March 3,1997. Mr. Calabrese requested a hearing on the denial on l March 14,1997. Administrative Judge G. Paul Bollwerk, III was appointed to preside in 4

the administrative proceeding. Judge Bollwerk issued an order regarding a number of procedural matters on March 27,1997. The Staff's response follows. l DISCUSSION

1) The Staff has no objection to a request for a Sn-inF under 10 C.F.R.

i 2.1201 et seq., on the Staff's proposed denial of an SRO license for Mr. Calebrese.  ;

2) A Notice of Appearance of Charles A. Barth, Office of the General Counsel, l 2

is enclosed. ,

3) The Staff expects to provide the Board and Mr. Calabrese with the Hearing File required by 10 C.F.R. I 2.1232 within thirty days, that is, by Wednesday, May 7, 1997.

4) Facility procedures EO-100-104, EO-100-112, and EO-100-113 will be hand delivered to the Board on or before Monday, April 7,1997, and to the Service List on that day by mail. The relevant parts of those procedures together with appropriate backround and collateral material will, of course, be included in the Hearing File submitted by May 7,1997.
