PROPOSED IMPOSITION OF CIVIL PENALTY - $8,800-This is to inform the Commission that a Notice of Violation and Proposed Imposition of Civil Penalty in the amount of $8,800 will be issued on or about

-March 06, 1997, to Connell Limited Partnership, a radiography licensee.

This action is based.on a Severity Level II problem consisting of three violations of radiography safety requirements that resulted in a radiation exposure in 1

excess of NRC's limits, The exposure occurred to a radiographer employed by i

another licensee, Tulsa Gamma Ray. Inc., who conducted radiography in O

Connell's facility.

The exposure associated with the incident was 6.465 rems total effective dose equivalent, resulting in an annual exposure to the radiographer.of 8.3 rems (the annual limit is 5 rems).

k The violations committed by Connell were classified at Severity Level II in

. the aggregate, In accordance with the Enforcement Policy, $8,800 is the base, j

value for a Severity Level II problem. A civil penalty at the base value;is i

i being proposed after consideration of identification and corrective actions.

l The licensee was not given credit for identification because the violations i

were discovered only after the Tulsa Gamma Ray radiographer's alarm ratemeter.

corrective actions, which the staff believes were prompt and comprehensive.

It should be'noted that the. licensee has not been specifically informed of the enforcement action. The schedule of issuance and notification is:

The licensee has thirty days from the date of the Notice in which to respond.

Following NRC evaluation of the response', the civil penalty may be remitted.
