Tennessee Valley Authority EA 96-269 Sequoyah Nuclear Plant. Units 1 and 2 Docket Nos. 50-327 and 50-328 Sub.iect:

IMPOSITION OF CIVIL PENALTY - $50.000 By EN 96-083 dated November 14. 1996, the Commission was notified of the intent of OE to issue a Notice of Violation and Proposed Imposition of Civil Penalty in the amount of $50,000 to the Tennessee Valley Authority.

This action was based on a Severity Level III problem consisting of four violaticns identified at the Sequoyah Nuclear Plant relating to the fire protection program.

The licensee responded to the Notice in a letter dated December 19. 1996.

that letter, the licensee agreed that the violations occurred; however, it maintained that the NRC's categorization of the violations and proposed civil penalty of $50,000 was inconsistent with the Enforcement Policy and requested that the NRC reconsider the severity level of the violations and mitigate the associated civil penalty in its entirety. After careful consideration of the licensee's response, the staff has concluded that the licensee did not provide an adequate basis for reduction of the severity level or mitigation of the civil penalty.

Accordingly, an Order Im)osing Civil Monetary Penalty in the amount of $50.000 has been issued today.

Jnder the terms of the Order, the licensee may either pay the civil penalty or request a hearing within 30 days of the date of the Order.
