. General Licensee (10 CFR 31.5)

PROPOSED IMPOSITION OF CIVIL PENALTY - $500
. This is to inform the Comission that a Notice of Violation and Proposed
. Imposition of Civil Penalty in the amount of Five Hundred Dollars will be issued on or about December 3,1985 to DelMonte Corporation. This action is based on the unauthorized removal and improper disposal of a generally licensed Filtec gauge containing 100 mil 11 curies of americium-241.
It should be noted that the licensee has not been specifically informed of the enforcement action.
The Regional Administrator has been authorized by the Director, Office _of Inspection and Enforcement, to sign this action. The schedule of issuance and notification is:
Mailing of Notice December 3, 1985 Telephone Notification of Licensee December 3, 1985 A news release has been prepared and will be issued about the time the licensee receives the Notice. The State of Indiana will be notified.
The licensee has thirty days from the date of the Notice in which to respond.
Following NRC evaluation of the response, the civil penalty may be remitted, mitigated, or imposed by Order.
