OFFICE OF ENFORCEMENT NOTIFICATION OF SIGNIFICANT ENFORCEMENT ACTION

Subiect:
ORDER PR0HIBITING INVOLVEMENT IN NRC-LICENSED ACTIVITIES (EFFECTIVE IMMEDIATELY)
This is to inform the Commission that ari Order Prohibiting Involvement in j
NRC-Licensed Activities (Effective Immediately) is being issued on February 18, 1997 to Mr. James Mulkey, an unlicensed individual who was the Vice 1
President / Radiation Safety Officer of Power Inspection Inc., (PI) an NRC i
licensee.
The action is based on inspection and investigation which concluded j
that Mr. Mulkey engaged in deliberate misconduct by:
(1) submitting to NRC licensees inaccurate information concerning eddy current qualification certification examination results and )ersonnel certification summaries; i
(2) providing to the NRC a letter whic1 contained inaccurate information j
relating to whether corrective. actions had been taken in response to a previous Notice of Violation; and (3) providing false information to the NRC l
during a telephone discussion with a representative of the NRC.
l The Order prohibits Mr. Mulkey from engaging in NRC-licensed activities for a period of 5 years and requires that, if Mr. Mulkey is currently engaged in NRC-licensed activities with another NRC licen.see, Mr. Mulkey imediately i
cease such activities and inform the NRC of the name, address and telephone number of the employer.
In addition, the Order requires that, the first time Mr..Mulkey engages in an NRC-licensed activity following the five year l
prohibition Mr. Mulkey notify the NRC prior to the 3erformance of the licensed activity or his being employed to perform NRC-licensed activities.
i The staff consulted with the Commission on this action in SECY 97-013, and the Comission approved the issuance of the action by SRM dated February 13, 1997.

It should be noted that the Individual has not been specifically informed of i
the enforcement action.

The individual has twenty days from the date of the Order in which to request
