Dear Mr. Doub:
I am pleased ~to acknowledge your letter of December 6, 1985 concerning a proposed revision.to the NRC nuclear export regulations, 10 CFR 110, to reclassify primary coolant pumps and control rods from their present category as utilization facilities to that of components subject to Section 109.b of the Atomic Energy Act.
As you are aware, the Commission considered reclassification of primary coolant pumps and control rods during its review of the proposed amendment to 10 CFR Part 110 which was published for comment in March 1984 At that time, the NRC staff recommended the reclassification of the pumps and control rods as Section 109.b components and the Executive Branch commented favorably.on this recommendation; however, Commission approval was not forthcoming and this proposal was not incorporated into the final version of the amended regulations which became effective in January 1985.
The Commission has considered your request and sees no new circumstances which warrant reopening this issue at this time.
The Forum's expression of interest on this issue is appreciated.
