IMPOSITION OF CIVIL PENALTY - $80,000 By EN 85-74 dated October 24, 1985, the Comission was notified of the intent of IE to issue a Notice of Violation and Proposed Imposition of Civil Penalty in the amount of Eighty Thousand Dollars ($80,000) to Maine Yankee Atomic Power Company. This action was based on the fact that all four channels for the low steam generator pressure trip function of the Reactor-Protective System and three of four channels for the low steam generator pressure trip function of the Feed-water Trip System were inoperable. This resulted in a subsystem of the Reactor Protective System and the Feedwater Trip System being inoperable.
The licensee responded to the Notice in a letter dated November 27, 1985. After careful consideration of the licensee's response, the staff has concluded that the violation did occur as set forth in the Notice of Violation and Proposed Imposition of Civil Penalty and that a sufficient basis for reduction of the proposed severity level was not provided in their response. Accordingly, an Order Imposing Civil Penalty in the amount of $80,000 has been issued today.
Under the terms of the Order, the licensee may within 30 days of the date of the Order, pay the civil penalty or request a hearing.
