-I.am writing in response to your fax of February 14, 1997, requesting the

~ U.S. Nuclear Regulatory Commission's (NRC) permission for the Russian Research Centre "Kurchatov Institute" (RRC KI) to utilize RELAP5/ MOD 3.2 to perform safety analyses and audit calculations in support of joint U.S./ Russian Federation core conversion efforts at the Seversk (Tomsk) and Zheleznogorsk

(Krasnoyarsk) plutonium production reactors. The overall goal of.this project, the cessation of production of weapons-grade plutonium by the year 2000, is an important non-proliferation goal shared by both the U.S. and the Russian' Federation.

As you know, the agreement between NRC and RRC KI for participation by RRC KI in the thermal-hydraulic code applications and maintenance program (CAMP) indicates'that the use of the RELAP code by the RRC KI is for the purpose of reactor and plant systems research and. licensing. Further, the code should not be used for other benefits not related to the study of reactor safety.

The NRC concludes that the use by the RRC KI of the RELAP code to perform safety analyses and audit calculations in support of core conversion efforts is consistent with the terms and conditions of the CAMP agreement. The NRC has no objection to the RRC KI's using RELAP for these activities.

As I indicated during our discussions while you were in Washington, the NRC remains committed to ensuring that safety is afforded highest consideration during core conversion efforts.

I trust that you share this resolve and will work actively with us to further this goal.
