Dear Mr. Owendoff:

I am responding to your letter of February 28, 1997, in which you asked for  ;

the Nuclear Regulatory Commission's support to quickly and efficiently '

complete the surface phase of the cleanup of sites under Title I of the )

Uranium Hill Tailings Radiation Control Act (UMTRCA). The staff is committed  :

to support DOE's requirements under the law. j Regarding yotr concern that the Title I work is second priority to the Title II actions 't is true that casework associated with new applications and with  !

the specific high priority sites of Atlas-Moab and American Nuclear Corporation Gas Hills has been prioritized higher than the Title I work.

However, the Title I work has been given priority over all the other Title II reclamation work Title II license renewals, and Title II amendments related to operational flexibility. These priorities have been provided to DOE's Albuquerque Operations Office staff, along with the Uranium Recovery Operating Plan for fiscal year 1997 (FY97).

During your meeting last August with Mr. John Greeves and his staff of the Division of Waste Management, both DOE and NRC agreed to establish and work within schedules that would achieve the licensing of all the sites by the mandated end of the surface project. The Uranium Recovery Branch (URB) staff met with DOE Headquarters and Albuquerque staff, and set baseline dates that will achieve this goal. Biweekly telephone conferences and periodic management discussions between our staffs are being used to discuss details of and impacts to those schedules as the licensing process proceeds.

In response to your request, the latest schedule for licensing the Title I sites is enclosed. This indicates that eight sites are presently licensed.
