NRC STAFF RESPONSE TO APPLICANTS' STATEMENT OF MATERIAL FACTS AS TO WHICH THERE IS N0 GENUINE ISSUE TO BE HEARD REGARDING JOINT INTERVENORS' CONTENTION 10.1 (DOSE-RATE EFFECTS)
Appended to their Motion for Summary Disposition of Contention 10.1, the Applicants submitted " Applicants' Statement of Material Facts as to Which There is No Genuine Issue to be Heard Regarding Joint Intervenors' Contention 10.1 (Dose-Rate Effects)." That document contained 11 numbered Statements of Material Fact which, pursuant to 10 C.F.R. 9 2.749(a), must be either controverted by the other parties or will be deemed admitted for purposes of any litigation which may involve Contention 10.1. As noted in the attached Affidavit of Hukam C. Garg, the Staff is in agreement with all of Applicants' Statements except numbers 3 and 11, which the Staff believes require some clarifi-cation. However, the Staff's clarification of paragraphs 3 and 11 of Applicants' Statement of Material Facts does not alter the Staff's 8508300247 BM1826 PDR ADOCK 00000424 C
