preliminary decision on this Direction Setting issue (DSI). Therefore, based on a review of the public comments received on this DSI, I continue to support the Commission's preliminary decision that favored Option 2 (Continue the Ongoing Program with j
Improvements) and Option 3 (Decrease Oversight of Low-Risk Activities with Continued i
Emphasis in High-Risk Activities).

The staff should give serious consideration to using an enhanced participatory rulemaking process in making appropriate revisions to Part 35 and the Commission's i
1979 Medical Policy Statement, if necessary. In addition, since there appeared to be l
broad support among the commenters for the adoption of Option 1 (Increase Regulatory Responsibility), the staff should also consider the feasibility of using this i
enhanced partic patory process for soliciting a,d evaluating the views of the i
j participants on whether NRC should expand the scope of our regulatcry oversight to l
include one or more of the higher-sisk activities identified in Option 1. This effort should l
include an assessment of the need for legislative changes to address any additional responsibility that derives from this effort.
I also continue to endorse the direction that was given by the Commission to the staff in the Commission's preliminary decision on consulting with ACMUI and the use of professional medical organizations and societies in developing guides and standards.
