APPLICANTS' RESPONSE TO NEW ENGLAND COALITION ON NUCLEAR POLLUTION'S REQUEST FOR CLARIFICATION AND OBJECTION TO BOARD ORDER OF NOVEMBER 4, 1985 On November 14, 1985, New England Coalition on Nuclear Pollution (NECNP) submitted a request for Clarification and Objection to Board Order of November 4, 1985 (NECNP Motion).
The NECNP Motion seems to assume that the Board made rulings in its Order of November 4, 1985, which the Board did not.
It also appears that the real purpose of the filing is to obtain for NECNP a guaranteed right of cross-examination even though NECNP fails to demonstrate any need therefore (by filing a cross-examination plan or otherwise as the Board may require).
Contrary to NECNP's assertion, there is 8512O20336 851125

I no guaranteed unfettered right of cross-examination in NRC proceedings.
It may well be that the matters, if any, raised by subsequent submission will be susceptible to resolution on a motion for summary disposition.
We respectfully suggest that after the supplementary filings are made and incorporated in the record is the proper time to deal with the matters raised by the NECNP motion which should at this time be denied.
