This responds to your leter of September 20,1996, to James M. Taylor requesting completion of the " Questionnaire on Fiscal Year 1996 Activities" by March 31,1997.

Please note that effective February 16,1997, L. Joseph Callan became NRC's Executive Director for Operations upon Mr. Taylor's retirement. Following the guidelines as set forth in the instructions for the questionnaire, we have reviewed only Sections A through H.

Enclosed you will find the U.S. Nuclear Regulatory Commission's (NRC) completed questionnaire.

The NRC does not have Federal land management responsibilities and, therefore, does not directly engage in maintaining or restoring archeological or historic properties that may be identified during the environmental review process for issuing permits or licenses. ,

4 However, NRC licensees are required to take the mitigative measures necessary to protect such properties. As a regulatory agency, NRC does not incur any direct costs associated  ;

with the protection or enhancement of archeological and historic resources.

Resoonse to C.4: 1 l Wolf Creek Nuclear Power Plant - While excavating a boat ramp across the lake  !

! from the Wolf Creek Nuclear Powe'r Plant. located near Burlington, Kansas, a >

l U.S. Nuclear Regulatory Commission (NRC) licensee conducted an archeological disturbance review. The licensee found no evidence of archeological significance.

River Bend Nuclear Power Plant - An annual flyover was conducted by the NRC l licensee for the River Bend Nuclear Power plant, located near Baton Rouge.

l Louisiana. The flyover, a part of the emergency plan for the nuclear power plant, took place within a five mile radius of licensee controlled area. No l

environmental or archeological disturbances were disclosed.

Cabot Performance Materials - The Cabot Performance Materials (CPM) facility l near Boyertown Pennsylvania is authorized under source material license SMB-l 920 to process ores and tin slags to extract tantalum (Ta) and Niobium (Nb).

l Through an environmental assessment (EA), conducted in FY96 by NRC in support of the license renewal it was noted that four sites within a 5-mile radius of the CPM facility are listed on the National Register of Historic Places. The

, closest historic site is 0.75 miles west of the facility. There is no impact I from operation of the facility on these sites.

Shieldallov Metalluraical Cor3 oration - The NRC prepared a Draft Environmental Impact Statement (DEIS) for t1e on-site disposal of radioactive slag piles at the Shieldalloy Metallurgical Corporation facility in Cambridge. Ohio.

Sheildalloy obtained a license from NRC to process ores and mineral concentrates containing radioactive materials. These radioactive materials were segregated from the incoming ore during processing at the plant, resulting in slag - a waste byproduct. Shieldalloy proposed to NRC that the ,

slag piles be left in place as part of the decommissioning of the facility. .

rather than shipped offsite to a disposal facility. The DEIS for this project '

includes an analysis of archeological impacts. After NRC staff consulted with the Ohio Historic Preservation Office, it was determined that there were no i

known archeological sites in the project area. The closest site is 0.3 miles from the facility and will not be affected by on-site disposal of the slag.

Portland General Electric Comoany - On November 26, 1996. NRC's Spent Fuel Project Office (SFP0) issued an environmental assessment (EA) and finding of

( no significant impact related to the construction and operation of the proposed Trojan Independent Spent Fuel-Storage Installation (ISFSI). The EA considered the historical and archeological, as well as cultural and i

socioeconomic resources that might be impacted by the proposed ISFSI. The NRC 1

staff consulted with the Oregon. State Department of Energy in preparation of i the EA.

American Heritage Commission (NAHC). The Tribe has a burial ground on the  !
