EXPIRATION OF SENIOR OPERATOR LICENSE
Dear Mr. Mushinski:
This letter is to confirm our understanding that your Senior Operator License has expired and from discussions with the Director of Licensing, Safety and j Nuclear Compliance for the facility that you will not perform any actions requiring an operator license until you are relicensed.
The NRC staff recognizes that there was confusion over changes in the regulations among a number of facilities and individuals regarding license '
renewal, and that your activities have been as required by the NRC-approved requalification program for your facility. However, as a licensed operator, you have a personal responsibility to ensure that you comply with all the provisions of your license, including ensuring that you have an active license if you perform licensed activities. Failure to comply with license requirements in the future could result in enforcement action against you.
The NRC plans to inspect your facility to determine if the facility allowed you to perform duties requiring an operator license after your license had expired. Su.h violations have resulted in enforcement action at t..;other facility and could result in enforcement action against your facility.
You are not required to respond to this letter. However, if you choose to provide a response, please provide it to me within 30 days at the U.S. Nuclear Regulatory Commission, Mail Stop Oll-R20, Washington, D.C. 20555.
Section 2.790 of the NRC's " Rules of Practice," Part 2, Title 10, Code of Federal Regulations, requires that records or documents compiled for enforcement purposes be placed in the NRC Public Document Room (PDR). A copy of this letter with your address removed, and your response, if you choose to submit one, will be placed in the PDR.
