! You were one of several members of the public who wrote to the Nuclear Regulatory i Commission (NRC) expressing concerns over the use of VECTRA Technologies, Inc.,

!' NUHOMS dry-shielded canister (DSC) system for the storage of spent nuclear fuel. In i addition to these letters, a formal Petition was filed on December 5,1995, by Mr. Terry l Jonathan Lodge on behalf of the Toledo Coalition for Safe Energy, Alice Hurt, Charlene  ;

i Johnston, Dini Schut, and William Hoops (the Petitioners). This Petition raised concerns '

! regarding the safety of the DSC system, specifically due to a reduction in the thickness of I cask welds compared to values provided in the safety analysis report for the NUHOMS i cask. The Petition also questioned the Commission's administrative process by which 4 VECTRA was permitted to deliver the canisters to the Davis-Besse Nuclear Power Station, i and by which the licensee for Davis-Besse was allowed to use the DSCs. ,

j On February 5,1997, Dr. Carl J. Paperiello, Director of the Office of Nuclear Material i Safety and Safeguards, NRC, issued a Director's Decision under Title 10, Section 2.206 of i the Code of Federal Regulations (10 CFR 2.206). The Petition was granted in part and denied in part. The Decision stated that the NRC Certificate of Compliance for VECTRA's standardized NUHOMS should be modified to require the vendor to perform an inspection .

j following the fabrication of each DSC. A rulemaking is needed to make this revision to the l certificate and is being initiated by the NRC staff. The NRC rulemaking process includes 1 l publication of proposed rulemakings in the Federal Reaister for the purpose of soliciting i public comments.

i I Because the continued storage of spent fuelin the DSCs at Davis Besse does not pose i

! undue risk to the public health and safety, the Director's Decision stated that no technical

basis exists to require the DSCs to be unloaded pending completion of the rulemaking. In i addition, the Director's Decision noted that VECTRA has already been cited for a i nonconformance with NRC regulations, and there was no basis provided in the Petition to l take further action in this regard.

Davis-Besse has developed loading and unloading procedures for handling spent fuel.

These procedures were tested during dry-run exercises conducted by the licensee prior to loading spent fuelinto DSCs at Davis-Besse. The dry-run exercises and subsequent dry-cask operations at Davis-Besse have been observed by NRC inspectors. Based on this, the Director's Decision found no basis in the Petition for requiring a halt to dry-cask operations j

at Davis-Besse. Accordingly, the Petition was granted to the extent that it requests an i agency rulemaking and was denied in all other respects.
