Dear Mr. Grandin:
This will acknowledge receipt of your letter dated February 5,1997, and your check for $2,500 in payment for the civil penalty proposed by NRC in a letter dated January 6, 1997.
1 In your letter, you take exception to the finding that the violation resulted, in part, from careless disregard for an NRC requirement.
The finding of l
careless disregard focuses on your December 11, 1996 letter with attached statement from a Grandin employee.
It is apparent from the facts of this case that, at least as of February 1996:
(1) Grandin had notice of the requirement to file Form NRC 241 before conducting work in an area under NRC jurisdiction; l
(2) you relied on a Grandin employee to act on this requirement; (3) the employee dropped the matter when he left the office for an extended period of time; and (4) during this time period, Grandin conducted licensed activities in an area under NRC jurisdiction without filing an NRC Form 241 or obtaining an NRC license.
These facts do demonstrate careless disregard.
Since you paid the civil penalty, we consider this matter closed. We will retain a copy of your letter in the file associated with this enforcement action.
Your corrective actions will be examined during future inspections.
